California regulates Uber and Lyft as transportation network companies under Public Utilities Code section 5430 and following. The insurance that applies is decided by the state of the app at the moment of impact. There are three periods:
Which period applied is a factual question answered by the platform’s own trip data, not by the driver’s recollection. Getting that record is usually the first substantive step in the case, and it is one of the reasons these claims are not well suited to being handled alone.
One thing has moved recently and is worth checking rather than assuming. California reduced the uninsured motorist coverage that rideshare companies must carry, down from the one million dollar floor that applied for years. The figure now depends on when the policy was issued or renewed, so if the at-fault driver was uninsured, the applicable limit should be confirmed against the actual policy rather than what was true a year ago.
Usually more than one party can be responsible, and each can bring its own insurance:
California follows pure comparative fault, so partial responsibility reduces a recovery by your share instead of barring it.
A claim’s value cannot be known before the medical picture is clear, and nothing here predicts a result.
Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil injury or wrongful death action is filed in the judicial district where the incident arose. A collision in Los Angeles County is not filed downtown by default, and the Court’s filing locator settles which courthouse hears it.
No fee unless there is a recovery. Broukhim Legal PC takes rideshare cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147). Your first conversation is free, confidential and carries no obligation.

As a passenger you are in the strongest position in any collision, because you are almost never at fault. If the rideshare driver caused it, the platform’s primary liability coverage applies and the limit is one million dollars. If another driver caused it, their policy comes first, and the platform’s uninsured or underinsured coverage may sit behind it where that driver had too little. In practice a passenger claim often involves both insurers at once, which is a reason to have the trip record early.
Yes, and it should be. Uber and Lyft keep trip data showing exactly when the driver was logged in, when a request was accepted and when a passenger was collected. That record, not anyone’s recollection, decides which coverage applies, and the difference between periods can be the difference between a thirty thousand dollar limit and a one million dollar one. It is requested in writing, early.
Generally two years from the date of injury under Code of Civil Procedure section 335.1. Reporting the incident through the app is not the same as making a claim and does not extend any deadline. If a public entity vehicle was also involved, Government Code section 911.2 requires a written claim within six months and that shorter deadline governs.
The first conversation costs nothing. It is free, confidential and carries no obligation, which matters in a rideshare case because the coverage question usually has to be settled before anyone can say what the claim involves: whether the app was off, on and waiting, or on with a ride accepted decides which layer of the platform’s policy applies. Bring the trip receipt or the in-app record if you still have it. If the matter goes forward it is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement.
An early offer arrives before anyone knows what the treatment will cost, which is precisely why it arrives early. Accepting it closes the claim permanently, including for an injury that turns out to need surgery six months later. It is reasonable to say you will respond once you have legal advice, and nothing is lost by doing so.
It depends on the period and on who was at fault. Platform drivers are generally treated as independent contractors rather than employees, so workers’ compensation usually does not apply in the way it would in ordinary employment. If another driver caused the crash, their policy is the first route, with the platform’s uninsured or underinsured coverage behind it. Your own policy may or may not respond depending on whether it carries a rideshare endorsement, which many personal policies specifically exclude.
Then the question is which uninsured motorist coverage reaches the loss, and that answer has changed. California reduced the uninsured motorist limit rideshare companies must carry, down from the one million dollar floor that applied for years, and what applies now depends on when the policy was issued or renewed. Your own policy may also respond. Both need checking against the actual documents rather than against general assumptions.
