Mass tort cases for Santa Monica residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around Santa Monica. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a Santa Monica injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose. That puts a Santa Monica incident in the West District, at the Santa Monica Courthouse, 1725 Main Street, or the Beverly Hills Courthouse, 9355 Burton Way. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. Big Blue Bus is operated by the City of Santa Monica itself rather than by Metro or a joint powers authority, so a bus injury here is a claim against the City on that six-month clock. One practical warning: the address printed for Blue, the Transit Store at 1444 4th Street, carries the City’s own notice asking people not to send mail there, so it is not an address for presenting a claim, and the City Clerk’s current filing office, address and accepted methods should be confirmed with the Clerk before anything is sent.

Looking for a top-rated, trusted personal injury lawyer in Santa Monica?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of Santa Monica. We know how a Santa Monica claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

Your first conversation is free, confidential and carries no obligation. Tell us what happened in Santa Monica and find out where you stand.

COMMON QUESTIONS

Santa Monica questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In Santa Monica the Police Department’s Records Unit at 333 Olympic Drive sets the report fee only after the request is submitted, with a published ten-day response time, so have the date, time, location and incident number ready.

The first conversation costs nothing and creates no obligation. A Santa Monica injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

The insurer may try, but the City’s own records cut against the assumption. In its Vision Zero study session report of September 8, 2026, covering 2021 through 2025, Santa Monica recorded 77 pedestrian-involved fatal or severe injury crashes. The police records deemed a motorist at fault in 48 of them, the pedestrian at fault in 21, and assigned no fault in 8. Among the driver-at-fault cases, the single commonest primary collision factor recorded was a violation of the pedestrian’s right of way, 23 times, followed by other hazardous movement at 8 and unsafe speed at 7. Of the 31 bike-involved crashes, a motorist was at fault in 16, the cyclist in 11 and no fault was assigned in 4, with improper turning and driving under the influence the commonest driver factors. The City also found the crashes widely dispersed, with no single intersection seeing more than three and no corridor carrying more than 12 percent of the total, so there is no single deadliest street: Ocean Avenue and Santa Monica Boulevard each recorded 26, and Pico Boulevard 22. These are police determinations rather than court findings, and they do not decide civil liability, but they are a useful corrective to the idea that a person on foot or on a bike is usually to blame.

Six months from the injury, as a matter of statute. California Government Code section 911.2 requires a written claim for death, personal injury or personal property damage against a public entity to be presented not later than six months after the cause of action accrues, with other claims, including most real property claims, running to one year. That deadline applies whether or not the City advertises it, and it is far shorter than the ordinary two-year personal injury limitation period that applies between private parties. Confirm the City Clerk’s current filing office, address and accepted methods directly with the Clerk before sending a claim, and keep proof of what was sent and when.

No, and this surprises people because the city has two well known hospitals. Neither Providence Saint John’s Health Center nor Santa Monica UCLA Medical Center appears on the California Emergency Medical Services Authority list of designated trauma centers updated 8/25/2025. The Los Angeles County EMS Agency, which designates trauma centers in this county, assigns both of them in its umbrella directory effective 1 April 2025 to Ronald Reagan UCLA Medical Center, which the state’s list records as a Level I adult and Level II pediatric trauma center. Where a patient actually goes depends on their condition under county triage protocol, but a major trauma in Santa Monica is routed out of the city rather than to the hospital a few blocks away.

The West District. Local Rule 2.3(a)(1)(A) requires an unlimited civil injury or wrongful death case to be filed in the judicial district where the incident arose, and the West District has two courthouses: the Santa Monica Courthouse at 1725 Main Street and the Beverly Hills Courthouse at 9355 Burton Way. The Court’s guidance is that where a district has more than one location you use the courthouse address where you file and clerical staff correct the summons if the case is assigned elsewhere. So a Santa Monica case may be heard in Beverly Hills, which is normal rather than a problem.
