Roundup and Non-Hodgkin Lymphoma Claims in Los Angeles

Glyphosate exposure and non-Hodgkin lymphoma, reviewed from a downtown Los Angeles office by attorney Bejan Broukhim.

How a Roundup lawsuit works for Los Angeles clients.

If you worked with Roundup or other glyphosate weed killers and were later diagnosed with non-Hodgkin lymphoma, a Roundup lawsuit lawyer in Los Angeles can review whether you have a claim. Broukhim Legal PC reviews Roundup claims for gardeners, landscapers, farm and nursery workers and homeowners across Los Angeles County and California, and attorney Bejan Broukhim personally reviews each matter.

Key takeaways

  • Roundup claims turn on how much glyphosate a person was around, for how long and in what way. That part usually can be reconstructed from ordinary records.
  • The diagnosis at the centre of these cases is non-Hodgkin lymphoma, a group of blood cancers that includes diffuse large B-cell lymphoma, follicular lymphoma and chronic lymphocytic leukaemia.
  • The manufacturer disputes the link and regulators have reached different conclusions. A claim has to prove both the risk and that this person’s exposure contributed to this person’s cancer.
  • If you were exposed at work, workers’ compensation is not the limit. A claim against the product manufacturer is separate, is brought in the civil system, and is not cancelled by workers’ compensation benefits.
  • This is not a class action. Each claim is built on that person’s own exposure and diagnosis.
  • Broukhim Legal PC takes these cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your Roundup case?

  • Direct access to your lawyer. Bejan Broukhim personally reviews your matter and leads its strategy. You deal with the lawyer running your case, not an intake script.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Exposure rebuilt from real records. Payroll and employment records, pesticide applicator licences, California pesticide use reports, purchase records, photographs and co-workers who did the same job can show exposure when memory alone cannot.
  • Related exposures reviewed together. Working lives rarely involve one chemical. Where paraquat was also handled, or firefighting foam and PFAS are part of the history, those exposures are reviewed together rather than separately.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any offer is measured against a case that is ready to be tried.

Who may qualify to bring a Roundup claim?

A review generally needs two things: meaningful exposure to glyphosate and a diagnosis of non-Hodgkin lymphoma. Exposure is the part people assume cannot be shown, and it usually can.

  • Occupational users. Groundskeeping, landscaping, agriculture, nursery work, pest control, and school, park and city maintenance crews who applied the product by backpack or tank sprayer.
  • Residential users. For home use, the length and frequency of use across years matters far more than any single afternoon.
  • Diagnosis. Non-Hodgkin lymphoma, confirmed by a pathology report that names the subtype.
  • Families. If the person exposed has since died, the claim is brought by the surviving family under California’s wrongful death statute, Code of Civil Procedure section 377.60, and the firm reviews those as well.
  • Past diagnosis or finished treatment. A diagnosis made years ago or treatment that has ended does not by itself close the door.

What do Roundup lawsuits allege?

The herbicide at the centre of these cases is glyphosate, sold as Roundup and under other labels. In 2015 the World Health Organization’s cancer research agency classified glyphosate as probably carcinogenic to humans. Other regulators have reached different conclusions and the manufacturer disputes the link, which is argued in every one of these cases.

What a claim generally alleges is that the risk was known or knowable and was not adequately warned about, and that this person’s exposure contributed to this person’s cancer. Both halves have to be proved. Neither is assumed. There is consolidated federal litigation as well as cases in state courts.

What records should you gather for a Roundup claim?

Exposure is established from ordinary records, not memory alone. Being paid in cash does not erase it. Useful sources include:

  • Employment and payroll records that place you in groundskeeping, landscaping, agriculture, nursery work or pest control, and the names of the companies or homes where you worked.
  • Pesticide applicator licences and California’s own pesticide use reporting system, plus application records kept by employers, schools and cities.
  • Purchase records and photographs, the product brand, and the equipment you used.
  • Co-workers and supervisors who did the same job and can describe it.
  • Medical records: the pathology report naming the lymphoma subtype, the date of diagnosis, treatment records and the oncologist’s notes.

If you are not sure what you have, bring what you can. We request the medical records ourselves.

How long do you have to file a Roundup lawsuit?

  • Two years to file a personal injury lawsuit in California, under Code of Civil Procedure section 335.1.
  • Delayed discovery. For a cancer that appears years after exposure, the two years can run from when the injury and its likely cause were, or should have been, discovered. That rule is applied case by case.
  • Wrongful death. A claim for a death is brought by the people Code of Civil Procedure section 377.60 permits, and the timing depends on the facts.

Because the date of diagnosis and the date a link to the product was or should have been discovered differ from person to person, have your own timeline reviewed early instead of assuming you are inside or outside the window.

What compensation may be sought in a Roundup case?

A claim for a serious illness can include several categories of loss. What applies to you depends on your diagnosis, your treatment and the evidence, and no result can be promised or predicted:

  • Medical expenses, past and future, including chemotherapy, hospital care and monitoring.
  • Lost earnings and loss of future earning capacity, which matters for workers whose job was physical.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 where the illness was fatal.
  • Punitive damages under Civil Code section 3294 where a defendant is shown to have acted with malice, oppression or fraud. They are not awarded in every case.

Because this is not a class action, your claim stands on your own exposure and diagnosis, not on a group average.

How much does a Roundup lawyer cost?

No fee unless there is a recovery. Injury and mass tort matters are taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement rather than left to the end. Your first conversation is free, confidential and carries no obligation.

Mass tort claims are taken on for clients across Los Angeles County, including Santa Clarita, Long Beach, Pasadena, Glendale, Burbank, Torrance, Inglewood, Pomona, Downey, Norwalk, El Monte, Santa Monica and West Covina. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit the claim.

COMMON QUESTIONS

Roundup claims, answered plainly.

It can. Occupational claims tend to be stronger because the volume and duration are higher and the records are better, but heavy residential use across many years is reviewed on its own facts. What matters is how often, for how long, and how the product was handled, not the label on your employment.

Most people do not, and much of it is recoverable. Employers keep payroll and job records. California requires commercial pesticide use to be reported, and those reports can be requested. Applicator licences, training certificates, co-worker statements and photographs all help. An empty shoebox is not a reason to decide you have no claim.

California allows two years from the injury for most personal injury claims under Code of Civil Procedure section 335.1, but in cancer cases the clock is usually tied to when the diagnosis was made and when its connection to the exposure was or reasonably should have been discovered. A wrongful death claim runs from the date of death. A single date cannot be given honestly, so have yours assessed.

It comes down to a non-Hodgkin lymphoma diagnosis and an exposure history that can be documented. The pathology report naming the lymphoma subtype settles the first part. For the second, the review looks at the work you did or the years of residential use, how the product was mixed and applied, and which employment, licensing or California pesticide use records exist to support it. Where the person exposed has since died, the family’s wrongful death claim is reviewed on the same material. The first conversation is free, confidential and carries no obligation, and the scope of the work and the fees are agreed in writing before anything starts.

It is contested, and that disagreement is the central fight in these cases. The World Health Organization’s cancer research agency classified glyphosate as probably carcinogenic to humans in 2015. The US Environmental Protection Agency has reached a different conclusion, and the manufacturer disputes the link. A claim is built on expert evidence applied to one person’s exposure and one person’s diagnosis, which is why each is assessed rather than assumed.

A claim can still be brought. California Code of Civil Procedure section 377.60 allows a spouse, domestic partner, children and certain other dependants to bring a wrongful death claim, and the estate can separately pursue what the person themselves lost before death. The deadline generally runs from the date of death rather than the diagnosis, which sometimes helps.

You will be asked for the specifics: where and when you used or were around the product, in what role, for how long, the diagnosis and its date, and authorisation to collect your medical and employment records. Those records are reviewed and you are told candidly whether the claim proceeds. If it does, it is filed, and where a coordinated proceeding exists it joins that.

General information about California law, not legal advice, and no attorney-client relationship is created by reading it. Deadlines and outcomes turn on the facts of your own matter, so have yours reviewed. By submitting, you agree that Broukhim Legal PC may contact you about your inquiry by phone, text or email.
