California mass tort and multidistrict litigation. Social media harm, dangerous drugs, toxic exposure and defective devices.
Mass tort litigation is no longer limited to defective physical products. It now reaches the technology our children use every day, the water in our communities, and modern breakthrough pharmaceuticals. When multi-billion-dollar corporations, from Silicon Valley tech giants to global drug manufacturers, prioritise user engagement or profit margins over public safety, a standard personal injury claim is not enough.
Broukhim Legal PC provides formidable representation in Mass Torts and Multidistrict Litigation (MDL). We stand between injured plaintiffs and massive corporate defence teams. Whether the matter is a design defect in a social media algorithm or a chemical manufacturer’s environmental negligence, the firm brings the analytical rigour and courtroom authority needed to secure maximum global settlements or take corporate giants to trial. We are not intimidated by unlimited defence budgets.

It generally turns on three things: the product, drug or platform you used, the specific injury or diagnosis you have, and when each of those happened. Every one of these litigations has its own criteria, and they move as the science and the court rulings develop. A claim that qualified two years ago may not qualify now, and the reverse happens too. Screening is quick and costs nothing, and it is far better to be told early that there is no claim than to find out years later.
Usually not, and the difference matters. In a class action, representatives litigate for everyone and the result binds the class, typically with a single fund divided by formula. In a mass tort or multidistrict litigation you file and keep your own individual case (grouped with others before one judge for pretrial efficiency only), and it is valued on your own facts, your own injury and your own records. You are not a class member; you are a plaintiff.
It depends on the litigation and on your own dates, and those are two separate questions. Deadlines run from things like the date of injury or the date you reasonably could have connected it to the product, so two people who used the same thing can have very different clocks. Some litigations have also closed to new claimants entirely while remaining highly visible in advertising. Camp Lejeune, for example, closed to new claims in August 2024. The only reliable answer is a dated review of your own facts.
Increasingly, yes, and this is where most claims now fail. Courts overseeing these litigations have begun requiring objective medical proof rather than a description of symptoms; in the GLP-1 gastroparesis litigation, for instance, the court has required objective diagnostic testing at the time of diagnosis. The medical records are the case. If you have not been properly evaluated, that is the first step, and it is a clinical one before it is a legal one.
Probably not. A multidistrict litigation is consolidated before a single federal judge who may sit in another state, but that court handles pretrial proceedings and individual clients rarely appear there; cases that do not resolve are returned to where they were filed. Several of these litigations also run in California state court, including coordinated proceedings here in Los Angeles. You would be told at the outset where your case would live.
Sometimes, and it depends entirely on what you signed and what it covered. A release bars the claims and the parties it names and no more, so a different defendant, a different injury, or an injury that appeared later may remain open. Class settlements frequently exclude personal injury claims altogether. And a government enforcement settlement with a company is not the same thing as your individual claim, and generally does not resolve it. Bring the paperwork; that question is answered by reading it, not by guessing.
