Mass tort cases for West Covina residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around West Covina. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a West Covina injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose, and for West Covina addresses the Court’s own filing locator returns the East District at Pomona Courthouse South, 400 Civic Center Plaza. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. The City’s claim page opens with the warning “Before starting the claim process, please be sure you are filing your claim with the appropriate entity,” and the City of West Covina Claim for Damages (To Persons or Personal Property) instructs that claims for death, injury to person or to personal property “must be delivered personally to the City Clerk’s Office or postmarked and addressed to the City Clerk’s Office not later than six months after the occurrence,” citing Government Code section 911.2. The Clerk’s Office is at 1444 W Garvey Avenue S, Room 317, on 626-939-8433, and questions about a submitted claim go to Human Resources and Risk Management on 626-939-8450.

COMMON QUESTIONS

West Covina questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In West Covina the report can be requested at the Records counter at 1444 W. Garvey Ave or by email to reportrequest@wcpd.org at no charge, so there is little reason to wait on it.

The first conversation costs nothing and creates no obligation. A West Covina injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

Because the claim has to be personally delivered or postmarked, and the office that takes personal delivery is shut. The City Clerk’s Office publishes its hours as Monday to Thursday, 7:30 a.m. to 5:30 p.m., closed Fridays, and Human Resources and Risk Management keeps the same schedule. The police Records lobby in the same building is open on Fridays, which is exactly the sort of thing that misleads someone who has been there once already. If the six-month deadline falls on or near a Friday, post the claim well before it, keep the postmark, and do not plan to walk it in.

Almost certainly not, and this is West Covina’s most useful local quirk. Foothill Transit, which runs most of the bus service through the San Gabriel Valley, has its headquarters inside the city at 100 S. Vincent Ave., Suite 200, but it is governed as “a Joint Powers Authority of 22 member cities and the County of Los Angeles,” not as a City department. So the bus company’s front door is in West Covina while the defendant is a separate public entity. The City’s own claim page warns, in its own words, to “be sure you are filing your claim with the appropriate entity” before starting, and this is exactly the situation it has in mind.

Not to either Emanate Health hospital, for major trauma. Neither Emanate Health Queen of the Valley Hospital nor Emanate Health Inter-Community Hospital appears on the California Emergency Medical Services Authority list of designated trauma centers updated 8/25/2025. The Los Angeles County EMS Agency, the designating authority here, assigns both of them in its umbrella directory effective 1 April 2025 to Pomona Valley Hospital Medical Center, which the state’s list records as a Level II adult trauma center. The county’s Level I adult centers are all further west or south. For a claim, the consequence is familiar: an emergency record in one city and the trauma record in another.

By the state’s comparative measure it is close to the middle for a city its size, and we are not going to dress that up. In the Office of Traffic Safety rankings for 2023, where rank 1 is the worst and 62 the best, West Covina ranked 30th of 62 for total fatal and injury crashes, with 438 people killed or injured in the year, and toward the better end for pedestrians, cyclists and alcohol-involved victims. The raw count of 438 in a single year is the more meaningful number than the rank. The City publishes no Local Road Safety Plan or Vision Zero plan on its website, but it did nominate ten intersections for Highway Safety Improvement Program signal work with $3,184,700 of state funding, which is a crash-driven programme, so appearing on that list is itself informative. The City also publishes guidance on the daylighting law, explaining that “safety is improved by removing parked cars next to crosswalks” and that the rule applies to parked vehicles rather than those stopped in traffic.
