Mass tort cases for Norwalk residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around Norwalk. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a Norwalk injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose, which puts a Norwalk incident in the Southeast District at the Norwalk Courthouse, 12720 Norwalk Boulevard, so a Norwalk case stays in the city. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. A claim arising from the condition of a City street, a City vehicle or a City bus goes to the Norwalk City Clerk’s Department at 12700 Norwalk Boulevard, on (562) 929-5720, on the City’s “Claim for Damages to Person or Property” form, which is fillable online but “must be printed and signed before mailing or dropping off,” with mail to the Clerk at P.O. Box 1030, Norwalk, CA 90651-1030; the form states six months for death, injury to a person or personal property and one year for real property, notes that claims must be filed with the City Clerk under section 915a, and warns that presentation of a false claim is a felony under Penal Code section 72. Because the Sheriff polices Norwalk under contract, an injury arising from the conduct of a deputy or a Sheriff’s Department vehicle is a claim against the County of Los Angeles instead, delivered or posted to the Executive Officer, Board of Supervisors, Attention Claims, 500 West Temple Street, Room 383, on (213) 974-1440, with the same six-month deadline, and presenting to one entity does not preserve a claim against the other.

Looking for a top-rated, trusted personal injury lawyer in Norwalk?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of Norwalk. We know how a Norwalk claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

COMMON QUESTIONS

Norwalk questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In Norwalk it also matters who was involved, because the Sheriff polices the city under contract and a claim involving a deputy runs against the County rather than the City.

The first conversation costs nothing and creates no obligation. A Norwalk injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

It depends on what caused the injury, and getting it wrong can be fatal to a claim. For a City street, a City vehicle or a Norwalk Transit bus, the claim goes to the Norwalk City Clerk’s Department, 12700 Norwalk Boulevard, on (562) 929-5720, or by post to P.O. Box 1030, Norwalk, CA 90651-1030. Where the injury arises from a Sheriff’s deputy or a Sheriff’s vehicle, the deputies are County employees and the public entity is the County of Los Angeles, whose claim goes to the Executive Officer, Board of Supervisors, Attention Claims, 500 West Temple Street, Room 383, on (213) 974-1440. Both carry the same six-month deadline under Government Code section 911.2. Filing with one does not preserve a claim against the other, which is why the entity question belongs at the start of a case rather than the end.

Still the City of Norwalk. Norwalk Transit System is a department of the City and has operated fixed-route and paratransit service since 1974, serving Artesia, Bellflower, Cerritos, El Monte, La Habra, La Mirada, Santa Fe Springs, South El Monte and Whittier in addition to Norwalk. Its six fixed routes carry close to 6,290 passengers each weekday on the City’s own figures. So an injury on one of its buses in another city is a claim against Norwalk, presented to the Norwalk City Clerk on the six-month deadline. If the vehicle was a Metro bus or train instead, the claim goes to Metro Customer Relations at One Gateway Plaza, Los Angeles.

That genuinely depends on which side of the station you were on. At the Norwalk/Santa Fe Springs Metrolink Station, 12700 Norwalk Boulevard, the City publishes that parking is under City of Norwalk jurisdiction on the west side and City of Santa Fe Springs jurisdiction on the east side, with overnight parking available only on the west, Norwalk, side. Jurisdiction is not the same thing as ownership or maintenance responsibility, so the correct defendant has to be established rather than assumed, and that work is worth doing in the first weeks while the six-month deadline still has room in it. Photographs that fix exactly where you were, with the station behind you, are unusually valuable here.

Mostly no, and it would be dishonest to suggest otherwise. In the Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, Norwalk ranked 33rd of 62 cities its size for total fatal and injury crashes with 365 victims, 49th of 62 on the composite measure and 53rd of 62 for speed-related collisions, all better than or close to the middle of its group, and 59th of 62 for alcohol-involved victims, among the best records. The real exception is motorcycles: 24 victims, ranked 13th worst of 62. Norwalk also has a current construction project on Firestone Boulevard, which the City lists as in construction and which involves removing a median to add a lane and bike lanes, so roadway conditions on that corridor are actively changing.
