Key takeaways

  • Vehicle Code section 21200 gives a cyclist the same rights and the same duties as a driver. You are not a guest on the road.
  • You generally have two years to file an injury lawsuit in California, but only six months to present a claim if a street defect or any public entity is involved.
  • California is a pure comparative fault state: a share of the blame reduces a recovery, it does not end the claim.
  • For adults a helmet is not required by law. Not wearing one can bear on a head injury, but not on the collarbone, shoulder, hip or wrist injuries that are most common.
  • If the driver fled, your own uninsured motorist coverage, or that of a relative you live with, may respond even if you own no car.
  • Broukhim Legal PC takes bicycle accident cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your Los Angeles bicycle accident case?

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury law and holds an active California law license, State Bar number 183036.
  • The cyclist is not blamed by default. Insurers often open by saying the rider ran the light or came out of nowhere. We answer with the physical damage, the sightlines and any footage along the route.
  • Right rules, right insurance. Dooring, unsafe passing and drivers who turn across a bike lane are governed by specific Vehicle Code sections, and we trace every policy, including your own uninsured motorist coverage.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

What should you do after a bicycle accident in Los Angeles?

  1. Get medical care the same day, even if you feel fine. Adrenaline hides injuries, and a gap in treatment is the first thing an insurer points to.
  2. Call the police and get the report number. If the driver left, report that too and note any plate, vehicle description or direction of travel.
  3. Photograph everything: the scene, the junction, the driver’s vehicle, any car door or lane marking involved, and your injuries.
  4. Keep the bicycle, helmet and clothing as they are. The damage shows how the collision happened, so do not repair or discard them.
  5. Get witness names and numbers, and note nearby businesses or homes with cameras, since footage is often overwritten within days or weeks.
  6. Do not give a recorded statement to the driver’s insurer, and do not sign anything, until you have spoken to a lawyer.

Who is liable for a bicycle accident in California?

Usually a driver, but not always only a driver. Depending on how the crash happened, more than one party can be responsible, and each can bring its own insurance:

  • The driver whose negligence caused the collision, such as a right hook, an unsafe pass, running a light or opening a door into a rider.
  • An employer, when the driver was working, such as delivery vehicles and company cars.
  • A public agency, for a dangerous road condition, a rail groove or a failed signal, under Government Code section 835. These claims carry the six month deadline.
  • A manufacturer, when a defective part of the bicycle, such as a frame, fork or brake, caused the crash.

What rules decide a Los Angeles bicycle accident claim?

A handful of Vehicle Code sections settle most of these cases, and almost none of them come up in the first call with the insurer:

  • Section 21200 gives a cyclist the same rights and the same duties as a driver.
  • Section 22517 bars opening a vehicle door into traffic unless it is reasonably safe. When a cyclist is doored, the fault is with the person who opened it, even though this is the case where the rider is most often blamed.
  • Section 21760 requires drivers to give a cyclist at least three feet when passing, and if that is not possible, to slow down and pass only when it is safe.
  • Section 21202 says a cyclist does not have to ride at the right edge when there are obstacles, parked cars, a narrow lane or a turn ahead.

On helmets, it is worth being exact, because it is the first thing used against a rider. Section 21212 requires a helmet only for riders under 18, so an adult without one is not committing an offense. Under comparative fault it can reduce the part of a claim tied to a head injury, but it does not affect the collarbone, shoulder, hip or wrist injuries seen most often in these crashes.

California follows pure comparative fault, so partial responsibility reduces your recovery by your share instead of barring it. An early percentage from an insurer is an opening position, not a finding.

What insurance pays after a bicycle crash?

California’s minimum liability limits are $30,000 per person and $60,000 per accident since 1 January 2025, which falls well short of a serious injury. The value of a claim often depends on finding the other layers:

  • The driver’s liability policy, and any umbrella policy above it.
  • Uninsured and underinsured motorist coverage. If a driver fled, or has too little coverage, your own policy or that of a relative you live with may respond, even if you do not own a car.
  • Employer and commercial policies when the driver was working. If you were hurt while making deliveries, a separate workplace claim can also exist.

What compensation can you recover after a bicycle accident?

  • Medical expenses, past and future, including surgery, therapy and long term care.
  • Lost earnings and loss of future earning capacity.
  • Property damage to the bicycle, helmet, phone and other belongings.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life.
  • Punitive damages under Civil Code section 3294 where a driver acted with malice, oppression or fraud.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 when a collision is fatal.

A claim’s value cannot be known before the medical picture is clear, and nothing here predicts a result.

How long do you have to file a bicycle accident claim in California?

  • Two years from the date of injury to file an injury lawsuit, under Code of Civil Procedure section 335.1.
  • Three years for property damage only, under Code of Civil Procedure section 338.
  • Six months to present a written claim if a street defect, a rail groove or any public entity is involved, under Government Code section 911.2. This shorter deadline governs, and missing it usually ends the claim.

Have your date confirmed at the start rather than assuming the two year rule applies. Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), a case is filed in the judicial district where the collision happened, which the Court’s filing locator identifies.

COMMON QUESTIONS

Bicycle claims, answered plainly.

No. California requires a helmet only for riders under 18, under Vehicle Code section 27803, and an adult riding without one has broken no law. A driver’s insurer will still raise it, usually to argue a head injury would have been less severe. That is an argument about the extent of the injury, not about who caused the collision, and it is answered with medical evidence rather than conceded.

It settles nothing. Fault is established from the physical evidence: where the impact landed on the vehicle, where the bicycle came to rest, the damage pattern, the sightlines at that junction and any footage from nearby businesses or a doorbell camera. A driver’s recollection given at the roadside is one account among several, and often the least reliable.

Generally two years from the date of injury under Code of Civil Procedure section 335.1. If the claim involves a public entity, such as a city street defect, a Metro vehicle or a transit authority, Government Code section 911.2 requires a written claim within six months, and that shorter deadline governs. Because a missed deadline ends a case whatever its merits, the date is worth confirming at the outset.

That is a dangerous condition of public property claim against whichever body maintains the road, which in Los Angeles may be the city, the county, Caltrans or a transit authority. It needs a written claim within six months, photographs of the defect with something for scale, and evidence that the body knew or should have known about it. Prior complaints and repair records often supply that.

Often yes. Uninsured motorist coverage on your own auto policy generally reaches you while cycling, which surprises most riders, and a household member’s policy may reach you as well. The practical priority is a police report and a canvass for camera footage within days, because most systems overwrite within a week or two.

It depends on the medical picture, the time away from work and the long-term outlook, not on a formula. Cyclists tend to be hurt more seriously than the vehicle damage suggests, which is one reason an early offer made before treatment has finished is almost always low. Anyone who quotes a figure before the records exist is guessing.
