Key takeaways

  • An unidentified driver does not usually mean no recovery. Uninsured motorist coverage on your own policy exists for exactly this situation.
  • Report the collision to the police the same day. An uninsured motorist claim generally depends on a prompt report, and some policies set a short window.
  • Camera footage from shops, doorbells and parking structures typically overwrites within one to two weeks, so evidence is a race against time.
  • You generally have two years to file an injury lawsuit, but the uninsured motorist claim has its own policy notice requirements that can run far sooner.
  • Your own insurer becomes the opponent in an uninsured motorist claim. Do not give a recorded statement before you have advice.
  • Broukhim Legal PC takes hit and run cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your hit and run case?

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury law and holds an active California law license, State Bar number 183036.
  • Evidence chased at once. Cameras are canvassed, debris and paint transfer are documented and the police report is secured before the trail goes cold.
  • Your own coverage found. We review your policy for uninsured motorist cover, which reaches the policyholder, household members and, under most policies, the insured on foot or on a bike.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial.

What should you do after a hit and run in Los Angeles?

  1. Get medical care the same day, even if you feel fine. A gap in treatment is the first thing an insurer points to.
  2. Report it to the police and get the report number.
  3. Photograph the damage, the debris and any paint transfer before the vehicle is repaired. Part numbers and paint can identify a make and model.
  4. Walk the block and note every camera pointing at the scene: shops, residential doorbells and parking structures. Ask for the footage straight away.
  5. Report to the DMV within 10 days on form SR 1 if anyone was injured or the damage is over $1,000.
  6. Do not give a recorded statement to any insurer, and do not sign anything, until you have spoken to a lawyer.

Who is liable for a hit and run, and how is the claim proved?

The driver who left is liable for the injuries, but the case is decided by speed of evidence, not legal theory. Leaving the scene of an injury collision is a crime under Vehicle Code section 20001, and leaving after damaging an unattended vehicle is covered separately by section 20002. That means a police investigation runs alongside the civil claim and sometimes produces the identification. Where the driver is later named from footage, a partial plate or the police work, the claim changes shape and can proceed against the driver and any other responsible party, such as an employer when the driver was working. We handle:

  • Drivers who struck and left, where the uninsured motorist cover on your own policy becomes the claim.
  • Pedestrians and cyclists, whose own auto policy generally reaches them on foot or on a bike.
  • Parked and unattended vehicle damage, often the only trace left of the driver.
  • Denied uninsured motorist claims, where your own insurer disputes the circumstances, the injuries or the value.

California follows pure comparative fault, so partial responsibility reduces a recovery by your share and does not end the claim.

What insurance pays after a hit and run?

Most people assume that an unidentified driver means no recovery. In California the opposite is usually true:

  • Your own uninsured motorist coverage, which is written for this situation and carried by most California drivers, often without knowing. The claim is made against your own insurer.
  • A household member’s policy. If you were on foot or on a bike and have no car, a relative you live with may have cover that reaches you.
  • Medical payments coverage on your own auto policy, which can pay bills early regardless of fault.
  • The driver’s liability policy, if the driver is later identified. Minimum limits are $30,000 per person and $60,000 per accident since 1 January 2025.
  • Health insurance, which pays treatment as it happens and may later claim reimbursement from the settlement.

In an uninsured motorist claim your insurer pays out of its own pocket and will test the circumstances, the injuries and the value. Most policies also send the dispute to arbitration rather than a jury. It is a contested claim and is handled as one.

What compensation can you recover after a hit and run?

  • Medical expenses, past and future, including surgery, therapy and long term care.
  • Lost earnings and loss of future earning capacity.
  • Property damage to your vehicle and belongings.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life.
  • Punitive damages under Civil Code section 3294 against an identified driver who acted with malice, oppression or fraud.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 when a collision is fatal.

The value of a claim cannot be known before the medical picture is clear. It turns on the injury, the treatment still to come, the coverage available and the strength of the evidence.

What if there was no contact?

If another car forced you off the road without touching you, that is a phantom vehicle claim. California allows it, but it carries an extra requirement: the existence of the other vehicle must be corroborated by someone other than you or anyone else claiming on the policy. An independent witness, a passing driver who stopped, or footage will do it. Your own account, however consistent, will not be enough on its own.

How long do you have to file a hit and run claim?

  • Two years from the date of injury to file an injury lawsuit, under Code of Civil Procedure section 335.1.
  • Three years for property damage only, under Code of Civil Procedure section 338.
  • Six months to present a written claim if a public entity is involved, under Government Code section 911.2. This shorter deadline governs.
  • Your policy’s own notice and arbitration time limits for the uninsured motorist claim, which usually require prompt notice and are often shorter than two years.

Two deadlines run at once, so confirm both at the outset rather than assuming.

COMMON QUESTIONS

Hit and run questions, answered plainly.

Usually yes, through uninsured motorist coverage on your own policy. That cover is written for exactly this situation and most California drivers carry it, often without knowing. It reaches the policyholder, household members and, under most policies, the insured while walking or cycling. The claim is then made against your own insurer, which is a different exercise from suing another driver.

Report it to the police the same day and get the report number, because an uninsured motorist claim generally depends on a prompt report. Get examined. Photograph the damage, the debris and any paint transfer before the vehicle is repaired. Then walk the block and note every camera pointing at the scene: shops, residential doorbells, parking structures. Most of those systems overwrite within one to two weeks.

California regulation restricts surcharging a policyholder for a claim where they were not at fault. If a hit and run driver caused the collision, you are not the at-fault party. Insurers do sometimes get this wrong, and a mistaken surcharge can be challenged, but the fear of one should not be the reason a legitimate claim goes unmade.

That is a phantom vehicle claim, and California allows it, but it carries an extra requirement: the existence of the other vehicle must be corroborated by someone other than you or anyone else claiming on the policy. An independent witness, a passing driver who stopped, or footage will do it. Your own account, however consistent, will not be enough on its own.

It is common. In an uninsured motorist claim the insurer is paying out of its own pocket rather than another company’s, and it will test the circumstances, the injuries and the value. Most policies also send the dispute to arbitration rather than to a jury. It remains a contested claim, and it is handled as one.

Two deadlines run at once. The ordinary personal injury limit is two years from the injury under Code of Civil Procedure section 335.1. The uninsured motorist claim is governed by your policy, which usually requires prompt notice and sets its own time limit for demanding arbitration, often shorter. Both are worth confirming at the outset rather than assumed.
