Representation for people assaulted where a property owner should have prevented it. Attorney Bejan Broukhim brings years of California legal experience to every case.
If you were attacked or robbed on someone else’s property in Los Angeles, you may need a negligent security lawyer in Los Angeles who asks the right question: not who attacked you, but who let it happen. Broukhim Legal PC represents people injured by violence on poorly protected property across Los Angeles County and California, and attorney Bejan Broukhim personally reviews each case.

The claim is against whoever controlled the property and allowed a known risk to exist, not against the attacker. Depending on the facts, that can include:
If you were attacked while working, there can be two claims: a workers’ compensation claim against your employer, and a separate claim against the property owner or the security company when they are different. The second claim is the one that covers pain and suffering.
Foreseeability is proved from records, not impressions, and mostly from what had already happened at that same place. Useful evidence includes:
When a place builds up calls for violence over months and the owner changes nothing, that pattern is the case. The precautions reviewed are concrete: lighting in parking lots and hallways, locks and gates that work, cameras that are installed and switched on, access control and security staff where the risk of the place justifies it. The law does not demand a fortress, only reasonable action against a known risk.
California follows pure comparative fault, so partial responsibility reduces a recovery rather than barring it. Under Civil Code section 1431.2 each defendant is liable for non-economic damages only in proportion to its fault, so the owner’s own share of responsibility has to be proved with care.
Compensation usually comes from the liability insurance carried by the owner or operator of the property, and sometimes by a security company or a business tenant. A few practical points:
A claim’s value cannot be known before the medical picture is clear, and nothing here predicts a result.
Have your date confirmed at the start rather than assuming the two year rule applies. Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), a case is filed in the judicial district where the incident arose.
No fee unless there is a recovery. Broukhim Legal PC takes injury cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement. Your first conversation is free, confidential and carries no obligation.

Because the duty is not to prevent crime generally, it is to take reasonable precautions against violence that was foreseeable at that particular place. A car park with a string of robberies, an apartment block with a gate broken for months, a venue with repeated fights: in each the risk was known. Failing to respond to a known risk is what creates the liability, not the attacker’s conduct.
Not to this claim. A negligent security case is brought against the owner or operator of the property, not the assailant, and it does not require anyone to be identified, arrested or convicted. In practice most of these claims are made precisely because the attacker is unknown or has nothing, and the owner’s insurance is where the recovery actually sits.
Calls for service to that address, usually obtainable from the police department, together with incident reports the business kept, complaints from tenants or employees, security contracts and patrol logs, camera maintenance records, and the lease or management agreement setting out who was responsible for what. Patterns in those records are what turn an isolated event into a known risk.
Report the assault to the police and keep the report number. Get medical treatment and make sure the records reflect what happened. Photograph the location, particularly the lighting, any gate or door involved and any camera. Write down what you remember while it is fresh. Then send a written request that the owner preserve the footage, because it is usually gone within weeks.
It is the same area of law, premises liability, but the proof is different. A fall case asks whether the owner knew about a hazard on the floor. A security case asks whether they knew about a pattern of violence and did too little about it. The evidence comes from police and security records rather than inspection logs, and the injuries tend to be far more serious.
Generally two years from the assault under Code of Civil Procedure section 335.1. If the property belongs to a public entity, a housing authority or a transit agency for example, a written claim is due within six months under Government Code section 911.2. The practical deadline is shorter still, because the footage and the staff who were working that night both disappear quickly.
