There are two different situations. In the first, the person responsible has no insurance at all. In the second, which is much more common, the driver is insured but only at the minimum limits, and those limits do not cover even the hospital. In both, you still have to prove the other driver was at fault, using the police report, photographs, witnesses and video. California follows pure comparative fault, so a share of blame reduces a recovery rather than ending it, and where the other driver broke a traffic law Evidence Code section 669 can create a presumption of negligence.
The difference is who you are claiming against. Your own insurer must answer the claim, and it will test it exactly as another insurer would.
The minimum limits are a real improvement over the old figure of $15,000 that stood for decades, but a spinal surgery or an intensive care stay uses that amount easily. That is why the coverage that decides the case is often your own:
A case’s value cannot be known before the medical picture is clear. It turns on the injury, the care still to come and the coverage available.
The underlying injury deadline is generally two years under Code of Civil Procedure section 335.1, and three years for property damage only under section 338. If a public entity is involved, a written claim is due within six months under Government Code section 911.2. But these claims also run on the policy’s own rules, and the contractual clocks usually run sooner:
No fee unless there is a recovery. Broukhim Legal PC takes uninsured motorist cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires, and it also explains how the costs of running the case are handled. Your first conversation is free, confidential and carries no obligation.

Most likely yes. California insurers have to offer uninsured motorist coverage, and it can only be declined in writing, so a great many drivers carry it without remembering. It is listed on the declarations page, usually as UM or UIM with its own limits. If the written rejection cannot be produced, the cover may be treated as being in place regardless.
Not without telling your own insurer first. Most policies require written consent before you settle with or release the at-fault driver, because doing so removes the insurer’s right to recover from that driver afterwards. Settling without consent can void the underinsured claim entirely, and it is one of the most common ways these claims are lost.
Uninsured applies when the other driver has no cover at all, or cannot be identified. Underinsured applies when they have cover but not enough, and in California it works by offset: your limit is reduced by what the other driver’s insurer pays. A 100,000 dollar underinsured limit against a 30,000 dollar policy leaves 70,000, not 130,000, which surprises most people.
California regulation restricts surcharging a policyholder for a claim where they were not at fault, and in these claims you are not. Insurers occasionally apply one in error and it can be challenged. The fear of a surcharge should not be the reason a legitimate claim is left unmade, particularly where the cover was paid for precisely to meet this situation.
Because the money is now its own rather than another company’s. The duty of good faith it owes you is real and enforceable, but it does not oblige the company to accept your valuation. Expect the circumstances, the treatment and the figure all to be tested, and expect the dispute to go to arbitration rather than to a jury, as most policies require.
Two clocks run together. The underlying injury claim is subject to the two-year limit in Code of Civil Procedure section 335.1. The uninsured motorist claim runs on the policy, which usually requires prompt notice and sets its own period for demanding arbitration, often shorter. Both are worth confirming at the start rather than assumed.
