NEC Baby Formula Claims in Los Angeles

Necrotizing enterocolitis after preterm formula, reviewed from a downtown Los Angeles office by attorney Bejan Broukhim.

How an NEC baby formula claim works.

If your premature baby developed necrotizing enterocolitis after being fed a cow’s milk based formula or fortifier, you may need an NEC baby formula lawyer in Los Angeles who will obtain the hospital records, decide whether the feeding and the disease are connected, and protect your family’s claim. Broukhim Legal PC represents families in NEC formula claims across Los Angeles County and California, and attorney Bejan Broukhim personally reviews each case.

Key takeaways

  • NEC claims concern cow’s milk based preterm formulas and human milk fortifiers, including products sold under the Similac and Enfamil names by Abbott and by Mead Johnson.
  • These claims allege a failure to warn. Both halves must be proved: that the risk was known or knowable and not adequately communicated, and that feeding this product contributed to this baby’s disease.
  • Verdicts so far have been mixed. These cases are not automatic and depend entirely on what the medical record shows.
  • A child injured as a newborn generally has until two years after their eighteenth birthday to bring their own claim (Code of Civil Procedure section 352). A parent’s wrongful death claim runs from the date of death under the ordinary two year rule.
  • Broukhim Legal PC takes these cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your NEC baby formula case?

  • The hospital file, read closely. These claims turn on the neonatal intensive care unit record: gestational age, birth weight, the feeding orders and the day of diagnosis. We request that file and read it against the allegations before anything else.
  • Care for families who were there. Having signed papers you did not fully understand, or having accepted what the hospital recommended, is nobody’s fault and does not weaken the case. The claim is against the company that sold the product without warning of the risk.
  • Honest case evaluation. Because verdicts have been mixed, you are told plainly how your record looks rather than being promised anything.
  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California injury and mass tort law and holds an active California law license, State Bar number 183036.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

Who may qualify for an NEC baby formula lawsuit?

These claims generally involve a premature baby who:

  • Was fed a cow’s milk based preterm formula or a human milk fortifier in the hospital, including Similac or Enfamil products.
  • Was later diagnosed with necrotizing enterocolitis, a severe intestinal disease in which the tissue of the bowel becomes inflamed and can die.
  • Needed treatment ranging from stopping feeds and giving antibiotics to surgery, removal of part of the intestine or an ostomy, or developed short bowel syndrome.

The family of a baby who did not survive can bring a claim, and a baby who survived with lasting consequences has a case that is valued as lifetime care. If this happened years ago, the deadline is probably still open, as explained below.

What do the NEC baby formula lawsuits allege?

Necrotizing enterocolitis, known as NEC, is a severe intestinal disease that affects mainly premature infants. The allegation is that published research has long associated cow’s milk based preterm formulas and fortifiers with a materially higher risk of NEC in premature infants than human milk, and that neonatal units and parents were not adequately warned of that difference.

A claim generally alleges a failure to warn: that the risk was known or knowable, that it was not adequately communicated, and that feeding this product contributed to this baby’s disease. Neither half is assumed. There is consolidated federal litigation and there are cases in state courts. Verdicts have been mixed, which is worth saying honestly. This is also not a class action: each claim stays separate, built on that child’s own feeding records, diagnosis and outcome.

What records do NEC formula claims need?

The record that matters is the one from the neonatal intensive care unit, not what you have at home. Those files are detailed and hospitals keep them for a long time, which is one reason these claims remain viable years later. They include:

  • The gestational age and birth weight.
  • The feeding orders showing what the baby was given, which brand and on which days.
  • The day the diagnosis was made, with the imaging.
  • The surgical reports and pathology.
  • The discharge summary and the treatment file.

The family does not hold most of this. It is at the hospital and is requested with a signed authorization. We request the records for you, in Spanish if you prefer and with no cost up front.

How long do you have to file an NEC claim in California?

  • Child’s own claim. California Code of Civil Procedure section 352 pauses the limitation period while a claimant is under eighteen. A child injured as a newborn therefore generally has until two years after their eighteenth birthday to bring a personal injury claim in their own name.
  • Parent’s wrongful death claim. If the baby died, the claim is brought by the family members listed in Code of Civil Procedure section 377.60 and runs from the date of death under the ordinary two year rule of section 335.1.

The same tolling rule applies to other claims brought on behalf of children, including video game addiction and social media harm claims. Do not assume a deadline has passed because years have gone by. Have the dates reviewed.

What compensation may be sought in an NEC claim?

  • Medical expenses, past and future, including surgeries, an ostomy, hospital care and ongoing treatment.
  • Lifetime care costs where a child survived with lasting consequences such as short bowel syndrome.
  • Loss of future earning capacity where the injury limits what the child can do as an adult.
  • Pain, suffering and the loss of enjoyment of life for the child.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 if the baby did not survive.
  • Punitive damages under Civil Code section 3294, only where malice, oppression or fraud can be shown.

No outcome or value can be promised. It turns on the medical record, the strength of the link between the feeding and the disease and the course of the litigation.

How much does an NEC baby formula lawyer cost?

No fee unless there is a recovery. Broukhim Legal PC takes these cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement rather than left to the end. Your first conversation is free, confidential and carries no obligation.

COMMON QUESTIONS

NEC claims, answered plainly.

Probably not. California Code of Civil Procedure section 352 pauses the limitation period while a claimant is under eighteen, so a child injured as a newborn generally has until two years after their eighteenth birthday to bring a claim in their own name. A parent’s wrongful death claim is different and runs from the date of death. Have the dates checked rather than assuming.

You are not expected to. The neonatal unit’s feeding orders record every product given, with dates and volumes, and they are part of the medical record. A records request will reach them. Not remembering is not a reason to decide there is no claim.

That is common with premature birth and it is dealt with directly rather than avoided. Prematurity itself carries risk, and the defence will say that is the whole explanation. The question is whether the feeding contributed on top of it, which is a causation question for expert evidence read against the actual records.

The first conversation costs nothing, is confidential and carries no obligation. It covers the gestational age and birth weight, which hospital the baby was cared for in, roughly when the diagnosis was made, and what treatment followed. The neonatal unit’s feeding orders and the surgical and discharge records are then requested, because those documents rather than recollection decide the claim. If they do not support one, you are told that and nothing further happens. If they do, the matter is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, and the costs of running the case are explained in that same agreement.

Usually not. These claims are brought against the formula manufacturers on the basis that the risk was not adequately disclosed, not on the basis that the neonatal team did anything wrong. If the records suggested a clinical error you would be told, because that is a different kind of case with different rules and a much shorter deadline.

A claim can still be brought. California Code of Civil Procedure section 377.60 allows parents to bring a wrongful death claim, and the estate can separately pursue what the child suffered before death. That deadline generally runs from the date of death rather than being paused, which is why these are worth asking about sooner.

You will be asked for the specifics: the hospital, the date of birth and gestational age, what you remember of the feeding, when NEC was diagnosed, any surgery, and authorisation to collect the neonatal records. Those records are reviewed, including the feeding orders, and you are told candidly whether the claim proceeds. If it does, it is filed, and where a coordinated proceeding exists it joins that.

General information about California law, not legal advice, and no attorney-client relationship is created by reading it. Deadlines and outcomes turn on the facts of your own matter, so have yours reviewed. By submitting, you agree that Broukhim Legal PC may contact you about your inquiry by phone, text or email.
