Necrotizing enterocolitis after preterm formula, reviewed from a downtown Los Angeles office by attorney Bejan Broukhim.
If your premature baby developed necrotizing enterocolitis after being fed a cow’s milk based formula or fortifier, you may need an NEC baby formula lawyer in Los Angeles who will obtain the hospital records, decide whether the feeding and the disease are connected, and protect your family’s claim. Broukhim Legal PC represents families in NEC formula claims across Los Angeles County and California, and attorney Bejan Broukhim personally reviews each case.

These claims generally involve a premature baby who:
The family of a baby who did not survive can bring a claim, and a baby who survived with lasting consequences has a case that is valued as lifetime care. If this happened years ago, the deadline is probably still open, as explained below.
Necrotizing enterocolitis, known as NEC, is a severe intestinal disease that affects mainly premature infants. The allegation is that published research has long associated cow’s milk based preterm formulas and fortifiers with a materially higher risk of NEC in premature infants than human milk, and that neonatal units and parents were not adequately warned of that difference.
A claim generally alleges a failure to warn: that the risk was known or knowable, that it was not adequately communicated, and that feeding this product contributed to this baby’s disease. Neither half is assumed. There is consolidated federal litigation and there are cases in state courts. Verdicts have been mixed, which is worth saying honestly. This is also not a class action: each claim stays separate, built on that child’s own feeding records, diagnosis and outcome.
The record that matters is the one from the neonatal intensive care unit, not what you have at home. Those files are detailed and hospitals keep them for a long time, which is one reason these claims remain viable years later. They include:
The family does not hold most of this. It is at the hospital and is requested with a signed authorization. We request the records for you, in Spanish if you prefer and with no cost up front.
The same tolling rule applies to other claims brought on behalf of children, including video game addiction and social media harm claims. Do not assume a deadline has passed because years have gone by. Have the dates reviewed.
No outcome or value can be promised. It turns on the medical record, the strength of the link between the feeding and the disease and the course of the litigation.
No fee unless there is a recovery. Broukhim Legal PC takes these cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement rather than left to the end. Your first conversation is free, confidential and carries no obligation.
Mass tort claims are taken on for clients across Los Angeles County: Santa Clarita, Long Beach, Pasadena, Glendale, Burbank, Torrance, Inglewood, Pomona, Downey, Norwalk, El Monte, Santa Monica and West Covina. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit the claim. Broukhim Legal PC works from 550 S Hill Street in downtown Los Angeles.

Probably not. California Code of Civil Procedure section 352 pauses the limitation period while a claimant is under eighteen, so a child injured as a newborn generally has until two years after their eighteenth birthday to bring a claim in their own name. A parent’s wrongful death claim is different and runs from the date of death. Have the dates checked rather than assuming.
You are not expected to. The neonatal unit’s feeding orders record every product given, with dates and volumes, and they are part of the medical record. A records request will reach them. Not remembering is not a reason to decide there is no claim.
That is common with premature birth and it is dealt with directly rather than avoided. Prematurity itself carries risk, and the defence will say that is the whole explanation. The question is whether the feeding contributed on top of it, which is a causation question for expert evidence read against the actual records.
The first conversation costs nothing, is confidential and carries no obligation. It covers the gestational age and birth weight, which hospital the baby was cared for in, roughly when the diagnosis was made, and what treatment followed. The neonatal unit’s feeding orders and the surgical and discharge records are then requested, because those documents rather than recollection decide the claim. If they do not support one, you are told that and nothing further happens. If they do, the matter is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, and the costs of running the case are explained in that same agreement.
Usually not. These claims are brought against the formula manufacturers on the basis that the risk was not adequately disclosed, not on the basis that the neonatal team did anything wrong. If the records suggested a clinical error you would be told, because that is a different kind of case with different rules and a much shorter deadline.
A claim can still be brought. California Code of Civil Procedure section 377.60 allows parents to bring a wrongful death claim, and the estate can separately pursue what the child suffered before death. That deadline generally runs from the date of death rather than being paused, which is why these are worth asking about sooner.
You will be asked for the specifics: the hospital, the date of birth and gestational age, what you remember of the feeding, when NEC was diagnosed, any surgery, and authorisation to collect the neonatal records. Those records are reviewed, including the feeding orders, and you are told candidly whether the claim proceeds. If it does, it is filed, and where a coordinated proceeding exists it joins that.
