Key takeaways

  • Workers compensation is usually the only route against your own employer, and it pays treatment and part of lost wages without proving fault. It pays nothing for pain, permanent limitation or a life that changed.
  • For that, the claim has to reach somebody other than your employer: the general contractor, another subcontractor, the property owner, an equipment manufacturer, a supplier or a public entity.
  • These third-party claims run alongside the compensation case rather than replacing it, and in a serious injury they are almost always the larger part of the case.
  • You generally have two years to file, but only six months to present a written claim against a public entity.
  • Broukhim Legal PC takes construction accident cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your construction accident case?

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Every company on the site examined. Most sites have several businesses working at once, so the early work is finding who controlled the hazard, the equipment and site safety.
  • Safety records used. Cal/OSHA records and site safety documentation are often what make the case, and an inspection file after the accident can show which rule was broken.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury law and holds an active California law license, State Bar number 183036.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

What should you do after a construction accident in Los Angeles?

  1. Get medical care the same day and tell the doctor the injury happened at work.
  2. Report the injury to your employer promptly and keep a copy of anything you submit.
  3. Photograph the site, the equipment, any missing guards or railings and your injuries, and get the names of co-workers who saw what happened.
  4. Do not let the equipment be repaired or discarded until it has been preserved as evidence.
  5. Keep your pay records and any contract or work orders that show who you worked for and who directed the work.
  6. Do not sign a release or give a recorded statement to an insurer before you have spoken to a lawyer.

Who is liable for a construction accident in California?

On a Los Angeles site there are usually several candidates, and each one brings its own insurance:

  • The general contractor, responsible for the safety of the site as a whole.
  • Another subcontractor whose crew created the hazard, such as a trench, an unguarded opening or falling material.
  • The property owner, who may have left a dangerous condition.
  • The company that rented the scaffold or crane, and the supplier of materials or equipment.
  • An equipment manufacturer, when a machine failed or a safety device was missing.
  • A public entity, for a dangerous condition of public property under Government Code section 835. These claims carry the six month deadline.

The injured worker’s own employer is usually shielded from a lawsuit by the workers compensation system. That protection does not extend to the other companies on the site.

What does workers compensation pay, and what does it not?

Workers compensation is the system with your direct employer. In exchange for paying without arguing about fault, the law normally prevents you from suing that employer. It pays medical treatment and a portion of lost wages. It does not pay for pain and suffering, the permanent limitation or the life that changed.

A third-party claim does. If another subcontractor caused the accident, the equipment failed or the owner left a dangerous condition, there is a second, independent claim against them, and it is based on fault. In a serious injury that is almost always the larger part of the case. Health insurance may also pay treatment as it happens and later claim reimbursement from a recovery, which is negotiated before you receive a net figure.

What are your rights as an injured worker in California?

  • Immigration status does not decide your rights. California’s workplace protections are available to every worker regardless of immigration status, including the right to workers compensation and the right to claim against a responsible third party.
  • Retaliation is unlawful. Labor Code section 132a bars an employer from retaliating against a worker for filing a workers compensation claim. Firing, cutting hours or threatening someone for reporting an injury is illegal and can create its own claim.
  • A 1099 or cash pay does not decide your status. If you were told you are an independent contractor, the law looks at how your work was actually controlled, and many misclassified workers are entitled to workers compensation.

What compensation can you recover after a construction accident?

  • Medical expenses, past and future, including surgery, therapy and long term care.
  • Lost earnings and loss of future earning capacity.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life, which workers compensation does not pay.
  • Punitive damages under Civil Code section 3294 where a defendant acted with malice, oppression or fraud.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 when an accident is fatal.

A case’s value cannot be known before the medical picture is clear. It turns on the injury, the care still to come, the available insurance and the evidence on who caused the hazard.

How long do you have to file a construction accident claim?

  • Two years from the date of injury to file an injury lawsuit against a third party, under Code of Civil Procedure section 335.1.
  • Three years for property damage only, under Code of Civil Procedure section 338.
  • Six months to present a written claim if a public entity is involved, under Government Code section 911.2. This shorter deadline governs.

California applies pure comparative fault, so partial blame reduces a recovery and does not bar it. The workers compensation case has its own deadlines, so have your dates confirmed at the start.

How much does a construction accident lawyer cost?

No fee unless there is a recovery. Broukhim Legal PC takes construction accident cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Your first conversation is free, confidential and carries no obligation.

COMMON QUESTIONS

Construction questions, answered plainly.

Often yes. Compensation is generally the exclusive remedy against your own employer, but it does not touch a claim against anyone else on the site: the general contractor, another subcontractor, the property owner, an equipment manufacturer, a hire company. Those are ordinary injury claims and they can be brought alongside the compensation case. They are also where any recovery for pain and permanent limitation comes from.

California prohibits retaliation against a worker for pursuing a compensation claim, and a third-party claim is against a different company altogether. Those are the protections on paper. The practical answer is that most of these claims are made against a contractor or manufacturer the worker has no ongoing relationship with, and the question is worth raising openly at the first conversation rather than left unspoken.

California law states that a person’s immigration status is irrelevant to their right to recover for an injury, and it is generally not discoverable in a civil claim. The protection exists because the fear of raising it is precisely what some defendants rely on. It is a question to put to a lawyer directly, and the answer does not change the existence of the claim.

The Cal/OSHA inspection and any citation issued, the site safety plan, daily reports, toolbox talk sign-in sheets, the contracts between the contractors, equipment inspection and maintenance logs, and any photographs taken before the site was cleared. Much of it exists only because regulation requires it, and much of it disappears quickly once a project moves on.

Two years from the injury for the third-party claim under Code of Civil Procedure section 335.1, and six months for a written claim if a public entity is involved under Government Code section 911.2. The workers compensation claim has its own, much shorter reporting requirements. The two systems run on different clocks, which is why one is often filed while the other is quietly missed.

Possibly, and California product liability does not require proof that the manufacturer was careless, only that the product was defective and caused the injury. The practical requirement is preserving the equipment. Once it is repaired, returned to the hire company or scrapped, the claim becomes far harder to prove, so a written preservation demand needs to go out early.
