Key takeaways

  • In Los Angeles these cases rarely happen at the sea. They happen at an apartment complex pool, a borrowed pool at a party, or a hotel or gym pool where no one was watching.
  • Pool law is unusually specific, so the question is usually not whether a rule was broken but which one. That makes these claims document driven.
  • A near drowning is often the more serious claim, because oxygen deprivation can cause a brain injury needing lifetime care.
  • The defense that a parent was not watching reduces a recovery at most. It does not end the claim, and the duty to maintain the fence and the gate belongs to the owner.
  • You generally have two years to file, six months for a written claim against a public entity, and a child’s own claim is held open until they turn 18.

Why choose Broukhim Legal PC for your drowning accident case?

  • We build the case from before the day of the accident. The notices tenants gave management, county health inspections, correction orders no one followed, photos of the broken gate and maintenance history are requested formally and early, because those papers disappear.
  • We know the pool rules. The Swimming Pool Safety Act, the Health and Safety Code for public pools and local fencing and gate codes each set specific requirements that can be checked item by item.
  • Lifetime care is valued as lifetime care. Many cases are not fatal but involve a survivor with brain damage from lack of oxygen, and those claims are valued for the care they will require.
  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California injury and mass tort law and holds an active California law license, State Bar number 183036.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

What should you do after a drowning accident in Los Angeles?

  1. Get emergency medical care at once. Even a person who seems recovered after a near drowning should be examined, because oxygen deprivation can cause damage that appears later.
  2. Photograph the pool, the fence, the gate, the latch and any warning signs as soon as it is safe to do so, before anything is repaired.
  3. Write down what you reported before the accident. Keep any messages, notices or complaints sent to the manager, owner or host about the pool or the gate.
  4. Ask for the incident report from the property, hotel, gym or school, and note who responded.
  5. Collect witness names and keep the clothing and equipment involved.
  6. Do not give a recorded statement or sign anything for an insurer until you have spoken to a lawyer.

Who is liable for a drowning accident in California?

Depending on where it happened, responsibility can reach:

  • The owner or management company of an apartment complex that left a pool without a complete fence, a self-closing and self-latching gate, depth markings, rescue equipment in view, a way to call for help or compliant drain covers.
  • A hotel, gym or club that operated a pool with no one watching and the required safety features missing.
  • A homeowner or host of a residential pool, under the rules the Swimming Pool Safety Act sets for residential pools.
  • A public entity, if the pool belongs to a city, a county or a public school, under Government Code section 835. These claims carry the six month deadline.
  • A manufacturer or installer, where a defective drain cover, gate hardware or pool equipment played a part.

The duty to maintain the fence and the self-latching gate belongs to the owner. It cannot be passed to tenants or solved with a sign, and a notice posted only in English in a building where most residents speak Spanish is part of the problem, not a defense. No one may evict or punish a tenant for reporting the pool or for bringing a claim: Civil Code section 1942.5 prohibits that retaliation.

How is a drowning accident claim proved?

The law requires concrete, checkable things at a complex pool: a complete fence with no gaps, a gate that closes and latches by itself, depth markings, rescue equipment in view, a way to call for help and anti-entrapment drain covers. When a child dies or is injured, usually one of those is missing, and very often the tenants had already reported it.

Proof therefore comes from what existed before the day of the accident:

  • Notices the family or neighbors gave to management.
  • Inspections by the County Department of Public Health.
  • Correction orders that no one carried out.
  • Photos of the broken gate or fence.
  • The maintenance history of the pool.

The first thing the manager usually says is that the child was unsupervised. It is the usual defense and it does not close the case. California divides fault by percentage, so even if a jury finds some lapse by the family, that reduces the recovery and does not eliminate it. Under pure comparative fault the argument is also weakened by the fact that these rules exist precisely because supervision fails, and for very young children the law does not recognize negligence.

What compensation can you recover after a drowning accident?

  • Medical expenses, past and future, including emergency care, hospitalization, rehabilitation and long term nursing or home care.
  • Lifetime care costs and loss of future earning capacity where oxygen deprivation caused a brain injury.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 when a drowning is fatal, including funeral and burial costs.
  • Punitive damages under Civil Code section 3294 where a defendant acted with malice, oppression or fraud.

No value can be known before the medical picture is clear. It turns on the injury, the care still to come, the available insurance and the evidence of what safety rule was missing.

How long do you have to file a drowning accident claim in California?

  • Two years from the date of injury to file a personal injury lawsuit, under Code of Civil Procedure section 335.1.
  • Six months to present a written claim against a public entity, such as a city, county or public school pool, under Government Code section 911.2. This shorter deadline governs.
  • A child’s own claim is held open until they turn 18.

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), a case is filed in the judicial district where the incident arose, which the Court’s filing locator identifies.

How much does a drowning accident lawyer cost?

No fee unless there is a recovery. Broukhim Legal PC takes these cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement rather than left to the end. COMMON QUESTIONS

Drowning questions, answered plainly.

For residential pools the Swimming Pool Safety Act requires at least one approved safety feature, most commonly an enclosing barrier with a self-closing and self-latching gate that opens away from the pool, with the latch out of a small child’s reach. Public pools are regulated further under the Health and Safety Code, and local codes add their own requirements. Which rules applied, and whether the pool met them, is usually established from permit and inspection records.

That argument is made in almost every case, and California’s pure comparative fault rule means it reduces a recovery rather than ending one. It also sits awkwardly with the law itself: fencing and gate requirements exist because supervision lapses, and a barrier is meant to work in the moment an adult looks away. An owner who never installed one is not well placed to say that someone else should have compensated for its absence.

Often a larger one. A near drowning deprives the brain of oxygen, and the resulting injury can require therapy, supervision and support for the rest of a life. Those claims are built in the same way as any catastrophic injury, with a life care plan and an economist, and they are frequently worth more than a fatal case precisely because the costs continue.

Usually the owner or the management company, since a shared pool is a common area under their control. The lease and management agreement establish who was responsible for maintenance, inspection and gate repair, and the maintenance log, work orders and any prior complaints from residents establish what they knew. More than one party is often named until the documents settle it.

Generally two years from the incident under Code of Civil Procedure section 335.1. For a public pool or one operated by a school district or city, a written claim is due within six months under Government Code section 911.2. A child’s own claim is held open until they turn 18, but waiting is rarely sensible: the pool gets altered, the gate gets fixed and the witnesses move on.

Photographs of the barrier, gate, latch height and any signage, taken before anything is repaired, because repairs follow these incidents quickly. The names of everyone present. Any camera covering the pool area. Permit and inspection records can be obtained later, but the physical condition on the day cannot be, so a written preservation request is worth sending early.
