Key takeaways

  • The criminal case belongs to the state and decides punishment. Your civil claim is separate, it is yours, and it runs on its own timetable.
  • Waiting for a conviction can cost you the deadline: you generally have two years to file an injury lawsuit, and six months to present a claim if a public entity is involved.
  • Where the conduct shows a conscious disregard for the safety of others, California permits punitive damages under Civil Code section 3294.
  • An acquittal or a plea to a lesser charge does not end the civil claim, because the proof required in a civil case is lower.
  • Broukhim Legal PC takes these cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your drunk driving injury case?

  • Civil and criminal cases kept apart. We pursue your civil claim on its own track, while keeping an eye on the criminal case for evidence such as the arrest report and chemical test results.
  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury law and holds an active California law license, State Bar number 183036.
  • Every source of recovery. Beyond the driver, we look at insurance layers, other responsible parties and the state victim compensation program, so nothing is left on the table.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

What should you do after a drunk driving crash in Los Angeles?

  1. Get medical care the same day, even if you feel fine. Adrenaline hides injuries, and a gap in treatment is the first thing an insurer points to.
  2. Call the police and get the report number. The arrest and test records are central evidence of the other driver’s impairment.
  3. Exchange information with the other driver if you can safely do so, as Vehicle Code section 16025 requires: names, licence, insurance and registration.
  4. Photograph everything: the vehicles, the scene, signals, skid marks and any visible injury.
  5. Get witness names and numbers, and note where the driver had been drinking if you know.
  6. Report to the DMV within 10 days on form SR 1 if anyone was injured or the damage is over $1,000.
  7. Do not give a recorded statement to any insurer, and do not sign anything, until you have spoken to a lawyer.

Who is liable for a drunk driving crash, and how is it proved?

When a drunk driver is prosecuted, the people hurt often assume the matter is in hand. It is not. The criminal case is the state’s. You are a witness and a victim, but you do not control it, you do not decide whether there is a deal and you cannot withdraw it. What that judge can order is restitution, which usually covers specific documented costs and rarely approaches what the injury actually cost.

The civil claim is yours. It seeks past and future treatment, lost income, earning capacity, and pain and suffering. It moves in parallel and does not depend on the criminal case finishing. A conviction helps it, but waiting for one can cost you the deadline. Responsibility can sit with:

  • The impaired driver, whose negligence is the cause. Where the driver broke a traffic law, Evidence Code section 669 can create a presumption of negligence.
  • An employer, when the driver was working at the time, such as a delivery or company vehicle.
  • The vehicle owner, in some circumstances.
  • A public agency, where a dangerous road condition contributed, under Government Code section 835.

Evidence includes the police report, the arrest and chemical test records, witness accounts, video and, in serious cases, accident reconstruction. California also has one of the strictest rules in the country on the liability of bars and restaurants. As a general rule, a business that serves alcohol to an adult is not responsible for what that adult does afterward. The main exception is serving an obviously intoxicated minor. It is better to say so at the start than to create false expectations, although each case is reviewed for an exception.

What insurance pays after a drunk driving crash?

California’s minimum liability limits rose to $30,000 per person and $60,000 per accident on 1 January 2025. That is well short of what a serious injury costs, so the value of a claim often depends on finding the other layers:

  • The at-fault driver’s liability policy, and any umbrella policy above it.
  • Your own uninsured and underinsured motorist coverage, which applies when the other driver has no insurance, too little, or drove away.
  • Medical payments coverage on your own auto policy, which can pay bills early regardless of fault.
  • Employer and commercial policies, when the driver was working.
  • Health insurance, which pays treatment as it happens and may later claim reimbursement from the settlement. That reimbursement is negotiated before you receive a net figure.

There is also a state program for compensation to victims of crime, which can help with medical and funeral expenses while the civil claim moves forward. It is independent of the civil case and worth checking early.

What compensation can you recover after a drunk driving crash?

  • Medical expenses, past and future, including surgery, therapy and long term care.
  • Lost earnings and loss of future earning capacity.
  • Property damage to your vehicle and belongings.
  • Pain, suffering and emotional distress, and the loss of enjoyment of life.
  • Punitive damages under Civil Code section 3294. Impaired driving is one of the few traffic scenarios where California courts have allowed them. They are not automatic and require proof of a conscious disregard for the safety of others, but they change the shape of a case.
  • Wrongful death damages for the family under Code of Civil Procedure section 377.60 when a crash is fatal.

A case’s value cannot be known before the medical picture is clear. It turns on the injury, the treatment still to come, the available insurance and the strength of the evidence.

How long do you have to file a drunk driving injury claim in California?

  • Two years from the date of injury to file an injury lawsuit, under Code of Civil Procedure section 335.1.
  • Three years for property damage only, under Code of Civil Procedure section 338.
  • Six months to present a written claim if a public entity is involved, under Government Code section 911.2. This shorter deadline governs, and missing it usually ends the claim.

The criminal case does not pause any of these deadlines. Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), a civil case is filed in the judicial district where the crash happened, which the Court’s filing locator identifies.

How much does a drunk driving victim lawyer cost in Los Angeles?

No fee unless there is a recovery. Broukhim Legal PC takes drunk driving injury cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. COMMON QUESTIONS

Impaired driving questions, answered plainly.

Yes. The criminal case belongs to the state and decides punishment. Restitution can be ordered, but it is generally limited to documented economic loss and rarely approaches the full cost of a serious injury. Compensation for pain, permanent limitation and future care comes only through a civil claim, which is separate and must be brought within its own deadline.

No. A conviction is useful evidence, and in California a criminal conviction can prevent the driver from re-arguing the same facts in the civil case. But criminal matters can run for a year or more, and the civil deadline does not pause for them. The two proceed in parallel, with the civil claim preserved from the start.

They punish rather than compensate, and California allows them under Civil Code section 3294 where the conduct shows a conscious disregard for the safety of others. Driving while seriously impaired can meet that, particularly with prior offences. The standard of proof is higher than for ordinary damages, they are not insured against in California, and whether they are worth pursuing depends on what the driver actually has.

Rarely, and California is narrower here than most states. Business and Professions Code section 25602 generally protects a seller of alcohol from liability for what a customer does afterwards. The main exception is serving an obviously intoxicated minor. The exceptions are real but limited, and anyone suggesting a bar claim is straightforward in California is overstating it.

Impaired drivers are disproportionately underinsured, which is why uninsured and underinsured motorist coverage on your own policy matters so much in these cases. An employer’s policy may apply if the driver was working, and a rideshare platform’s cover may apply depending on the app’s state at the time. Finding every policy is usually more productive than pursuing the driver personally.

Get the police report number and the arrest details, because the breath or blood result and the officer’s observations become central evidence. Get examined. Photograph the vehicles and the scene. Keep anything the prosecutor’s office sends you, including victim notification letters. Then avoid giving the driver’s insurer a recorded statement until you have had advice.

General information about California law, not legal advice, and no attorney-client relationship is created by reading it. Deadlines and outcomes turn on the facts of your own matter, so have yours reviewed. By submitting, you agree that Broukhim Legal PC may contact you about your inquiry by phone, text or email.
