Key takeaways

  • California splits what most people think of as one case into two claims: the wrongful death claim, which belongs to the family, and the survival action, which belongs to the estate.
  • Code of Civil Procedure section 377.60 lists who may bring a wrongful death claim, and the list is narrower than most families expect.
  • For survival actions filed on or after 1 January 2026, the deceased person’s own pre-death pain and suffering is no longer recoverable. The filing date now carries real weight.
  • You generally have two years from the date of death to file, and six months to present a written claim if a public entity is involved.
  • Broukhim Legal PC takes these cases on a contingency fee: nothing up front, and no fee unless we recover for you.

Why choose Broukhim Legal PC for your wrongful death case?

  • We explain the two claims and who brings each. The family’s claim and the estate’s claim follow different rules, and we make sure both are considered from the first meeting.
  • We watch the filing date. The 2026 change to survival damages means that a case filed by 31 December 2025 and one filed after are treated differently, and we plan around it.
  • Respect for the family at a hard time. Immigration status of the deceased or of family members does not prevent a wrongful death claim in California, and we handle the paperwork and the records so you do not have to.
  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California injury and mass tort law and holds an active California law license, State Bar number 183036.
  • No fee unless we recover for you. You pay nothing up front, and if nothing is recovered you owe no fee.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

Who can bring a wrongful death claim in California?

Not every relative can. The list is in Code of Civil Procedure section 377.60, and it is narrower than most people expect.

  • First: a surviving spouse or registered domestic partner, and the children, including the children of a deceased child.
  • If none of them survive: those who would be entitled to the decedent’s property by intestate succession under state inheritance rules, which usually opens the door to parents or siblings.
  • Dependants: a putative spouse, a stepchild or a parent who was financially dependent on the deceased may also qualify.

One point affects many families. California does not recognize common law marriage. Living together for many years, by itself, does not give a right to claim. The putative spouse category exists for someone who believed in good faith that the marriage was valid, and it is one of the first things we review when a couple never married formally here.

What is the difference between a wrongful death claim and a survival action?

There are almost always two distinct claims, not one.

  • The wrongful death claim belongs to the family. It compensates them for their own loss: the financial support that has gone, the value of what the deceased did at home, and the companionship and guidance that cannot be replaced.
  • The survival action belongs to the estate and is brought by the personal representative under sections 377.30 and following. It recovers what the deceased person could have claimed had they lived, principally economic losses incurred between the injury and the death, including medical expenses of that period.

What changed for survival actions in 2026?

The change is recent enough that a lot of published material is out of date. Between 2022 and the end of 2025, a temporary amendment to section 377.34 allowed a survival action to recover the deceased person’s own pre-death pain and suffering. That amendment expired on 1 January 2026 and was not extended.

For cases filed on or after that date, those damages are no longer recoverable in a survival action, regardless of when the injury or the death occurred. Cases filed by 31 December 2025 keep them. In practice the date of death and the filing date now matter in a way they did not a year ago, and any page or article telling you otherwise was written before the sunset.

How is a wrongful death claim proved?

The claim is built on the same elements as any negligence case, with the death as the harm: that someone owed a duty of care, breached it, and that the breach caused the death. Evidence depends on what happened, and may include police, CHP or agency reports, photographs, witness accounts, video, medical and autopsy records and, in serious cases, accident reconstruction. Where a safety law was broken, Evidence Code section 669 can create a presumption of negligence. California applies pure comparative fault, so partial blame reduces a recovery rather than barring it, and under Civil Code section 1431.2 each defendant is liable for non-economic damages only in proportion to its fault.

What compensation can the family recover?

  • Loss of financial support the deceased would have provided.
  • The value of services the deceased gave to the household.
  • Loss of companionship, affection and guidance.
  • Medical expenses before death, and funeral and burial costs. When the family returns the body to another country, that cost is part of the claim and is often forgotten when it is calculated.
  • Economic losses of the deceased recoverable by the estate in a survival action.
  • Punitive damages under Civil Code section 3294 where the defendant acted with malice, oppression or fraud.

No value can be promised or known at the start. It depends on who survives, the deceased person’s age and earnings, the available insurance and the evidence of fault.

How long do you have to file a wrongful death claim in California?

  • Two years from the date of death, generally, under Code of Civil Procedure section 335.1.
  • Six months to present a written claim if a public entity is involved, such as a city or county vehicle, a public hospital, a transit agency or a school district, under Government Code section 911.2. Missing this deadline usually ends the claim.

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil wrongful death action is filed in the judicial district where the incident arose, so a collision in Los Angeles County is not filed downtown by default, and the Court’s own filing locator settles which courthouse hears it. This office is at 550 S Hill Street in downtown Los Angeles.

How much does a wrongful death lawyer cost?

No fee unless there is a recovery. Broukhim Legal PC takes these cases on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If nothing is recovered, no fee is owed. The fee agreement is put in writing and signed before any work starts, as California law requires (Business and Professions Code section 6147), and the costs of running the case are explained in that same agreement rather than left to the end. Your first conversation is free, confidential and carries no obligation.

COMMON QUESTIONS

Wrongful death questions, answered plainly.

Code of Civil Procedure section 377.60 sets the list. A surviving spouse or registered domestic partner, the decedent’s children, and the issue of any deceased child. If none of those exist, it passes to whoever would inherit by intestate succession. Certain dependants may also qualify, including a stepchild, a parent, or a putative spouse who depended on the decedent financially. California requires it to be brought as a single action rather than several, so heirs who are not getting along still have to be accounted for.

Yes, and the distinction matters. The wrongful death claim belongs to the family and compensates their loss. The survival action belongs to the estate and recovers what the deceased person could have claimed had they lived, mainly the economic losses between injury and death. They are usually brought together, by different claimants, and they are governed by different rules.

Generally two years from the date of death under Code of Civil Procedure section 335.1. If a public entity is involved, a city or county vehicle, a public hospital, a transit agency or a school district, Government Code section 911.2 requires a written claim within six months of the death. Because the filing date now also affects what damages are available, this is worth confirming early rather than late.

Yes, on 1 January 2026, and it is the single most important thing to know. A temporary amendment to section 377.34, in force from 2022, allowed a survival action to recover the deceased person’s own pre-death pain and suffering. That amendment expired and was not extended. For cases filed on or after 1 January 2026 those damages are no longer available in a survival action, whenever the injury or death occurred. Cases filed by 31 December 2025 keep them. A good deal of material published online still describes the old position.

Economic losses, which include the financial support the decedent would have provided, the value of household services, and funeral and burial expenses. And non-economic losses, which cover the loss of love, companionship, comfort, guidance and affection. California does not permit punitive damages in a wrongful death claim itself, although they may be available in an accompanying survival action in limited circumstances.

No. A civil claim is separate and runs on its own timetable and its own standard of proof, which is lower than the criminal one. A prosecution may proceed, fail, or never be brought at all without that determining the civil case. The deadlines above continue to run regardless, which is why waiting to see what happens in a criminal matter is rarely the right course.
