In the California Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, Santa Monica ranked 6th of 103 cities its size for motorcyclists killed and injured, with 33 victims. That sits inside a wider pattern worth seeing whole. The same table puts the city 39th of 103 for total people killed and injured in traffic, with 417 victims, close to the middle of its group, then 3rd of 103 for pedestrians, 6th of 103 for motorcyclists and 8th of 103 for bicyclists. An ordinary city in its group for traffic generally is near the worst of it for everyone travelling without a metal shell around them. These rankings are rate-based, adjusted for population and daily vehicle miles travelled, so they say Santa Monica is worse than comparable cities rather than that it has California’s highest raw counts, and the Office of Traffic Safety cautions that they are indicators to be read against local circumstances.
The gap in the local record matters just as much. On 8 September 2026 the City’s Public Works Mobility Division gave the City Council a Vision Zero study session report counting 214 fatal or severe injury crashes between 2021 and 2025, of which 21 were fatal. It breaks those crashes out for pedestrians, 77 of them, and for bicyclists, 31, and states that 20 of the 21 deaths involved a pedestrian or a bicyclist. It publishes no equivalent breakdown for motorcyclists, and no fault analysis for them of the kind it publishes for the other two modes. So a rider here is in a position no car driver, cyclist or pedestrian is in: the state ranks this city near the worst in its group for people on motorcycles, while the City’s own severity reporting does not separate riders out. The practical consequence is that a Santa Monica motorcycle claim cannot borrow a published local figure for its own mode. It has to be built from the collision report, the scene, the vehicles and the physical evidence, which is where these cases are decided in any event.
The difficulty in a motorcycle claim is usually bias rather than law. Adjusters start from the assumption that the rider was going too fast or splitting lanes recklessly, and they assign a high comparative fault percentage early, before the evidence has been examined. Lane splitting is lawful in California, so the question is whether it was done at a reasonable speed in the conditions, not whether it happened. California is also a pure comparative fault state, which means a share of the blame reduces what you recover rather than ending the claim, and the percentage is normally the whole argument. It is answered with the physical evidence, the gouge and skid marks, the damage geometry, the helmet and the protective gear, and any camera footage, all of which has to be gathered before it disappears.
Who is responsible for the road depends on which road it was. The Santa Monica Police Department investigates collisions on city streets and its Records Unit at 333 Olympic Drive holds the report, on (310) 458-8491, with the fee set after a request is submitted rather than published in advance. Interstate 10 inside the city limits is a state highway maintained by Caltrans, recorded as the Santa Monica Freeway and, from postmile R2.155 to postmile R4.267, as the Ricardo A. Crocker Memorial Highway, named by Senate Concurrent Resolution 20 of 2007 for a Santa Monica police officer and Marine Corps major killed in Iraq in 2005. It begins in the city at State Route 1, the Pacific Coast Highway, also a state highway. Collisions there are normally California Highway Patrol matters and the roadway belongs to the state, which decides who a surface defect claim runs against. That question is sharper for a rider than for anyone else, because gravel, a utility cut or a sunken trench plate is an irritation in a car and a crash on two wheels.
A claim against the City over the road itself has to be built location by location here. Its September 2026 report found the 2021 to 2025 fatal and severe injury crashes widely dispersed, with no single intersection carrying more than three and no corridor more than 12 percent of the total, Ocean Avenue and Santa Monica Boulevard accounting for 26 each and Pico Boulevard for 22, and it concluded that what remains cannot be resolved by a small number of hot-spot projects. So no street here is the city’s worst street, and the useful record is the specific one: the High Injury Network the City is updating and the priority locations in its Local Roadway Safety Plan of 2022.
The deadline is generally two years against another driver and six months for a written claim against a public entity, which here includes Big Blue Bus, operated by the City itself. Cases are filed in the West District under Local Rule 2.3(a)(1)(A).
There is more on the Santa Monica personal injury page, and the wider practice on the Los Angeles motorcycle accident page. Santa Monica’s other collision pages cover car, pedestrian and bicycle claims. If your matter is a drug, device or product claim rather than a collision, Broukhim Legal PC also takes on mass tort and complex litigation work for people living in and around Santa Monica.

It depends on three things: whether a driver or a public entity failed in a duty owed to you, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it is confidential, it carries no obligation, and if there is nothing worth pursuing you will be told that rather than signed up. Do not let the machine be repaired or released to a salvage yard, keep the helmet and the gear, and bring your own policy, because rider injuries routinely exceed a minimum liability policy and the uninsured and underinsured motorist layers of your own cover often decide what the case is worth.
The first conversation costs nothing, it is confidential, and it carries no obligation. Injury matters are then taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is nothing recovered, no fee is owed. The costs of running a case, things like filing fees and medical records, are a separate category from the fee, and they are explained in the same agreement rather than left to the end. That agreement is put in writing and signed before any work starts, which is what California law requires, so there is no arrangement you have not read.
In an argument about a percentage, not out of the claim. California is a pure comparative fault state, so a share of the blame reduces what you recover and does not end the case. Lane splitting is lawful in California, so the question is whether it was done at a reasonable speed in the conditions. Both points are answered with evidence rather than assertion: the gouge and skid marks, the damage geometry on both vehicles, the helmet and gear, and any footage. Insurers assign a high percentage early, before any of that is examined, which is the main reason not to give a recorded statement in the first week.
Against another driver, generally two years from the date of injury under California Code of Civil Procedure section 335.1. Against a public entity, Government Code section 911.2 requires a written claim within six months for death, injury to a person or damage to personal property, and one year for other claims, and the six-month deadline governs. A public entity here can mean the City of Santa Monica for a street surface or a signal, Big Blue Bus, which the City operates itself, or the State where the road is Interstate 10 or State Route 1. Claims against the City are presented to the City Clerk’s Office, and the address and the current form should be confirmed with that office directly.
The West District. Los Angeles Superior Court Local Rule 2.3(a)(1)(A), amended effective 1 January 2026, requires every unlimited civil case for bodily injury, wrongful death or damage to personal property to be filed in the judicial district where the incident arose, so a Santa Monica crash is not filed downtown, including one on the stretch of Interstate 10 inside the city. The district’s civil cases are heard at the Santa Monica Courthouse, 1725 Main Street, or the Beverly Hills Courthouse, 9355 Burton Way, and the court’s guidance is to use the address where you file while clerical staff correct the summons if the case is assigned elsewhere.
Almost certainly outside Santa Monica, which matters to a rider because motorcycle injuries are disproportionately the kind that need a trauma centre. Neither hospital in the city is one. Under the Los Angeles County EMS Agency’s Trauma Center Umbrella Facilities Directory, Reference No. 506.2a, effective 04-01-25, both Providence Saint John’s Health Center and Santa Monica – UCLA Medical Center are assigned to Ronald Reagan UCLA Medical Center, which the state EMS Authority’s list of designated trauma centers, updated 8/25/2025, records as a Level I adult centre. The County EMS Agency designates the centres and the state authority publishes the list.
