In the California Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, El Monte placed 8th of 62 cities in its population group for people killed and injured in traffic collisions, with 553 victims, near the worst end of the list rather than near the best. The same table ranks El Monte 1st of 62 for hit and run collisions that killed or injured somebody, with 80 recorded, the worst rank in its size group statewide. Nighttime collisions ranked 10th of 62 with 59 and alcohol involved victims 10th of 62 with 74, while speed related collisions ranked 31st of 62 with 57, around the middle. The rankings weight counts against population and daily vehicle miles travelled, so they say El Monte is worse than comparable cities of its size and traffic volume, not that it has the highest raw counts in California.
That combination shapes a car claim here. Where a city is 1st of 62 for hit and run and 10th of 62 for nighttime collisions, a real share of crashes end with the other car gone, often in the dark, so the first job is identifying a defendant rather than arguing about fault. Nearby camera footage is usually overwritten within days, and your own policy has to be read for uninsured and underinsured motorist cover, because that is what the claim runs on if the driver is never found. The City’s Vision Zero Action Plan, published in February 2022 on collision data for 2008 to 2019, counted 1,543 collisions over those eleven years, 929 of them auto only, and an average of three deaths a year. Those are historic figures, not current counts.
Who investigates depends on the road. A collision on an El Monte surface street is an El Monte Police Department matter and the department holds the report. The City’s Vision Zero plan describes El Monte as bisected from east to west by Interstate 10 and surrounded by other major interstate and state highways, with large arterials branching off into slower local streets, so two crashes a short distance apart can involve different agencies and different owners of the road. Interstate 10 is a state highway, designated under state law as the El Monte Police Officer Donald Ralph Johnston Memorial Highway between Route 164 in Rosemead and Interstate 605 in Baldwin Park, and a collision there is normally a California Highway Patrol matter rather than a City one.
Two deadlines run at once, and the shorter governs. Against a private driver it is two years from the date of injury under Code of Civil Procedure section 335.1. If a public entity may be responsible, for a signal fault, a road defect or a City vehicle, Government Code section 911.2 requires a written claim within six months, and El Monte’s own form and City Clerk FAQ direct claims to the City Clerk’s Office at 11333 Valley Boulevard, City Hall E. California is a pure comparative fault state, so a share of blame reduces what you recover rather than ending the claim. An unlimited civil injury case arising in El Monte is filed in the East District, at Pomona Courthouse South, 400 Civic Center Plaza, Pomona, because the El Monte Courthouse has no civil division.
There is more on the city on the El Monte personal injury page and more on the law on the wider Los Angeles car accident practice page. El Monte’s other collision pages cover pedestrian, bicycle and motorcycle claims. If your matter is a drug, device or product claim rather than a collision, Broukhim Legal PC also takes on mass tort and complex litigation work for people living in and around El Monte. This site also has a Spanish version, reachable from the Español link in the menu.

It depends on three things: whether another road user’s carelessness caused the collision, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it is confidential, it carries no obligation, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the report or its number, photographs, the name of anyone who treated you, and your own insurance policy. El Monte ranked 1st of 62 cities its size for hit and run in 2023, the worst rank in its group, so uninsured motorist cover on your own policy is often what the claim has to run on.
The first conversation costs nothing, it is confidential, and it carries no obligation. Injury matters are then taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is nothing recovered, no fee is owed. The costs of running a case, things like filing fees and medical records, are a separate category from the fee, and they are explained in the same agreement rather than left to the end. That agreement is put in writing and signed before any work starts, which is what California law requires, so there is no arrangement you have not read.
Two deadlines run at once and the shorter controls. Against a private driver it is two years from the date of injury under Code of Civil Procedure section 335.1. If a public entity may be responsible, Government Code section 911.2 requires a written claim within six months of the cause of action accruing, and El Monte’s own claim form prints that rule in those terms. The form and the City Clerk FAQ both direct claims to the City Clerk’s Office at 11333 Valley Boulevard, City Hall E, El Monte, CA 91731. It must be signed under penalty of perjury and warns that claimants may be examined under oath and that presenting a false claim is a felony under Penal Code section 72.
The East District, at Pomona Courthouse South, 400 Civic Center Plaza, Pomona. Local Rule 2.3(a)(1)(A) requires every unlimited civil tort action for bodily injury, wrongful death or damage to personal property to be filed in the judicial district where the incident arose, so an El Monte crash is filed in the East District rather than downtown. The El Monte Courthouse on East Valley Boulevard is in that district but has no civil division at all, hearing criminal and traffic matters only. The Court’s own filing court locator returns a different district for some zip codes carrying the El Monte name, including 91770 and 91780, so the street address should be run through the locator rather than the city name.
Probably not in El Monte. Greater El Monte Community Hospital is not a designated trauma centre. In the Los Angeles County EMS Agency’s Trauma Center Umbrella Facilities Directory, Reference No. 506.2a, effective 1 April 2025, it appears as an umbrella facility assigned to Los Angeles General Medical Center, which the California EMS Authority’s Designated Trauma Centers list, updated 25 August 2025, records as a Level I adult and Level II paediatric trauma centre. Designation is made by the Los Angeles County EMS Agency, and the state authority publishes the list. Being taken to the nearest hospital is not the same as reaching a trauma centre.
No. California is a pure comparative fault state, so being partly responsible reduces what you recover in proportion to your share and does not bar the claim. An early accusation from an adjuster, that you were speeding or distracted or pulled out, is an argument about a percentage rather than about whether you have a case, and it is still worth answering with evidence because that percentage comes off the end figure. Speed related collisions in El Monte ranked 31st of 62 cities its size in the 2023 rankings, with 57, around the middle of the group, so a speed assumption is not one the local figures support on their own.
