In the California Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, El Monte ranked 16th of 62 cities in its population group for pedestrians killed or injured, with 35 victims. Pedestrians under 15 ranked 22nd of 62 with four victims and pedestrians aged 65 and over 20th of 62 with five, so both the youngest and the oldest sit in the worse half of the group rather than at either extreme. The city’s wider position is harder: 8th of 62 for all people killed and injured in traffic, 10th of 62 for nighttime collisions with 59, and 1st of 62 for hit and run collisions with 80, which is the worst rank in its size group statewide. These are rate based rankings, weighting counts against population and daily vehicle miles travelled, so they describe how El Monte compares with similar cities rather than any statewide raw total.
El Monte’s own Vision Zero Action Plan, published in February 2022 on collision data for 2008 to 2019, puts the pedestrian share in plain numbers. Of 1,543 collisions over those eleven years, 252 involved a pedestrian, and pedestrians or cyclists featured in 614 of them, which the plan records as 39.7 percent of the total. People on foot and on bikes are a small share of road users and close to two fifths of the collisions, which is why a pedestrian case is rarely a small one. The plan also maps a high injury network and places the worst concentrations at Peck Road and Lower Azusa Road in the north of the city and Peck Road and Garvey Avenue in the south. Those are historic figures, not current counts.
A pedestrian claim here usually turns on the physical scene rather than on vehicle damage: where the crossing was, whether it was marked, where the point of impact sat in the lane, what the lighting was, and whether a camera on a nearby business caught it. The El Monte Police Department investigates collisions on city streets and holds the report, and the City’s own FAQ requires you to attend the Police Lobby at 11333 Valley Boulevard in person to request it, with release generally in about ten business days and no charge. Footage near the scene is usually overwritten within days, so that canvass cannot wait for the report. Where the road itself contributed, through a missing or faded crossing, a signal fault, an obstructed footway or a sightline problem, the defendant may be the City, and the Vision Zero plan is the City’s own published record of where it had already identified risk.
That changes the timetable, not only the defendant. Against a driver you have two years from the date of injury under Code of Civil Procedure section 335.1. Against a public entity, Government Code section 911.2 requires a written claim within six months, presented to the City Clerk’s Office at 11333 Valley Boulevard, City Hall E, on the form the Clerk’s Office posts, which asks you to draw a diagram of the place of the accident and must be signed under penalty of perjury. California is a pure comparative fault state, so an argument that you crossed where you should not have reduces a recovery in proportion rather than ending the claim. An unlimited civil injury case arising in El Monte is filed in the East District, at Pomona Courthouse South, 400 Civic Center Plaza, Pomona, because the El Monte Courthouse hears no civil matters.
There is more on the city on the El Monte personal injury page and more on the law on the wider Los Angeles pedestrian accident practice page. El Monte’s other collision pages cover car, bicycle and motorcycle claims. If your matter is a drug, device or product claim rather than a collision, Broukhim Legal PC also takes on mass tort and complex litigation work for people living in and around El Monte. This site also has a Spanish version, reachable from the Español link in the menu.

It depends on three things: whether a driver or a public entity failed in a duty owed to you, what the medical record actually shows, and whether there is insurance or a public claim that reaches the loss. Those are the questions the first conversation is for. It is free, it is confidential, it carries no obligation, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the report or its number, photographs of the crossing, the name of anyone who treated you, and your own insurance policy. El Monte ranked 1st of 62 cities its size for hit and run in 2023, the worst rank in its group, so uninsured motorist cover matters even to someone on foot.
The first conversation costs nothing, it is confidential, and it carries no obligation. Injury matters are then taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is nothing recovered, no fee is owed. The costs of running a case, things like filing fees and medical records, are a separate category from the fee, and they are explained in the same agreement rather than left to the end. That agreement is put in writing and signed before any work starts, which is what California law requires, so there is no arrangement you have not read.
Two deadlines run together and the shorter one governs. Against a driver it is two years from the date of injury under Code of Civil Procedure section 335.1. Against a public entity, Government Code section 911.2 requires a written claim within six months of the cause of action accruing, and El Monte’s own claim form prints that rule in those words. The form and the City Clerk FAQ both direct claims to the City Clerk’s Office at 11333 Valley Boulevard, City Hall E, El Monte, CA 91731. It asks you to complete a diagram of the place of the accident on the reverse, must be signed under penalty of perjury, and warns that presenting a false claim is a felony under Penal Code section 72.
The East District, at Pomona Courthouse South, 400 Civic Center Plaza, Pomona. Los Angeles Superior Court Local Rule 2.3(a)(1)(A) requires every unlimited civil tort action for bodily injury, wrongful death or damage to personal property to be filed in the judicial district where the incident arose, so an El Monte collision is filed in the East District rather than downtown. The El Monte Courthouse on East Valley Boulevard sits in that district but has no civil division at all, hearing criminal and traffic matters only, so nothing civil is filed there. The Court’s own filing court locator returns a different district for some zip codes carrying the El Monte name, including 91770 and 91780, so the street address should be checked rather than the city name.
Most likely outside El Monte. Greater El Monte Community Hospital is not a designated trauma centre. In the Los Angeles County EMS Agency’s Trauma Center Umbrella Facilities Directory, Reference No. 506.2a, effective 1 April 2025, it appears as an umbrella facility assigned to Los Angeles General Medical Center, which the California EMS Authority’s Designated Trauma Centers list, updated 25 August 2025, records as a Level I adult and Level II paediatric trauma centre. Designation is made by the Los Angeles County EMS Agency, and the state authority publishes the list. That matters practically, because a pedestrian’s records are often split between the first hospital and the trauma centre, and both sets are needed.
No. California is a pure comparative fault state, so a share of responsibility reduces what you recover in proportion to that share and does not bar the claim. In a pedestrian case the allegation is usually that you crossed away from a crossing, crossed against a signal, or stepped from between parked cars, and it is answered with the scene rather than with argument: the point of impact, the position of the vehicle afterwards, the lighting, and any camera covering the junction. El Monte ranked 10th of 62 cities its size for nighttime collisions in 2023, with 59, so poor light is a common feature here and a reason to document conditions at the same hour.
