Mass tort cases for Long Beach residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around Long Beach. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a Long Beach injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose, which puts a Long Beach incident in the South District at the Governor George Deukmejian Courthouse, 275 Magnolia Avenue, so a Long Beach case stays in Long Beach. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. A claim against the City is presented to the City Clerk at 411 West Ocean Blvd, by mail, in person, or through the City’s online claims portal, and an older form showing 333 West Ocean Blvd carries an address that has been superseded. The City publishes its claim form in English, Spanish, Khmer and Tagalog, and states both deadlines plainly: six months for death, personal injury and personal property, and one year for other claims including real property.

Looking for a top-rated, trusted personal injury lawyer in Long Beach?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of Long Beach. We know how a Long Beach claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

COMMON QUESTIONS

Long Beach questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. Do not wait on the report in Long Beach, because the Police Department says releasing one may take up to about six months, which is as long as the deadline for a claim against the City.

The first conversation costs nothing and creates no obligation. A Long Beach injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

It should not be assumed. Long Beach Transit describes itself as “a nonprofit public benefit corporation formed in 1963.” Its board is appointed by the Mayor and the City contributes part of its operating budget, but it is not a City department, and it publishes no claims procedure, claim form or claims deadline. That means the route for a transit bus injury is a question to be settled at the outset rather than at the end. Presenting to the wrong entity, or on the wrong timetable, is how a good case is lost. A Metro A Line injury is different again, because claims against Metro go to its own legal services office.

The South District, at the Governor George Deukmejian Courthouse, 275 Magnolia Avenue in Long Beach. Local Rule 2.3(a)(1)(A) requires an unlimited civil action for bodily injury or wrongful death to be filed in the judicial district where the incident arose, and Long Beach has its own courthouse for that district, so a Long Beach case stays in Long Beach. That is not true of every city in the county, and it is a practical advantage for witnesses and for treating physicians who may be asked to testify.

Bad, and the City says so itself. In the Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, Long Beach ranked 1st of 15 cities its size for total fatal and injury crashes, with 3,774 victims, up from 3rd of 15 the year before. It also ranked 1st of 15 for pedestrians under 15 and 1st of 15 for nighttime collisions. The City’s Vision Zero plan, published July 2020, aimed for zero deaths and serious injuries by 2026; a City Manager memorandum of July 24, 2023 records 45 traffic fatalities in 2022.

Sometimes, but only if someone acts quickly. Long Beach is one of six jurisdictions California permits to run speed safety systems under Vehicle Code section 22425, with up to 18 systems, and none may be placed on a state route, freeway or expressway, so nothing on the 405, 710, 605, SR-91 or Pacific Coast Highway where it is SR-1. The statute requires that photographic evidence which does not result in a notice of violation “shall be destroyed within five business days after the photograph was first made.” Records tied to a citation are kept longer, and the statute allows disclosure in response to a subpoena in an individual case. The City’s warning period begins October 7, 2026 and citations begin December 7, 2026.
