Mass tort cases for Pomona residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around Pomona. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a Pomona injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose. That puts a Pomona incident in the East District at Pomona Courthouse South, 400 Civic Center Plaza, which is a genuine advantage because the courthouse is in the city. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. Pomona is a charter city and its City Clerk’s Office is the department its own published description makes responsible for “processing subpoenas, damage claims, and contracts/agreements,” so confirm the Clerk’s current filing address, form and accepted methods with that office before sending anything, and keep proof of what was sent and when.

Looking for a top-rated, trusted personal injury lawyer in Pomona?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of Pomona. We know how a Pomona claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

COMMON QUESTIONS

Pomona questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In Pomona it also matters exactly where it happened, because collisions on Interstate 10, State Route 60, State Route 57 and State Route 71 are normally California Highway Patrol matters while city streets are Pomona Police, and that decides who holds the report.

The first conversation costs nothing and creates no obligation. A Pomona injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

The East District, at Pomona Courthouse South, 400 Civic Center Plaza. Local Rule 2.3(a)(1)(A) requires an unlimited civil injury or wrongful death case to be filed in the judicial district where the incident arose, and for the East District the Court’s own filing locator returns Pomona Courthouse South. That is useful: the courthouse is in the city, so witnesses and treating doctors are not asked to travel across the county. Cases arising in El Monte are filed here as well, because the El Monte Courthouse handles criminal and traffic matters and has no civil division, and the Court’s filing locator also returns Pomona Courthouse South for West Covina addresses.

Most likely Pomona Valley Hospital Medical Center, which holds an adult Level II trauma designation on the state’s list updated 8/25/2025 and is itself the trauma center for its own catchment area under the Los Angeles County EMS Agency map effective 1 December 2017. That catchment also covers four other hospitals, Emanate Health Foothill Presbyterian, Emanate Health Inter-Community, Emanate Health Queen of the Valley and San Dimas Community, which are assigned to Pomona Valley under the County’s umbrella directory. Having the trauma center in the city is unusual in this part of the county and it simplifies a claim, because the medical records and any hospital lien come from one place.

Probably not. Bus service in the Pomona Valley is provided by Foothill Transit, a regional operator rather than a department of the City of Pomona, so a City claim form would be presented to the wrong entity. Identify the operator from the bus itself, the stop, the ticket or the trip record before any deadline runs. If the bus was a Metro vehicle, the claim goes to Metro’s own legal services office, which accepts claims only in person or by mail and rejects claims sent by email.

Possibly several entities at once, which is why these cases need sorting out early. The Foothill Gold Line extension is delivered by the Metro Gold Line Foothill Extension Construction Authority, a public agency separate from LA Metro, and the Pomona North station was dedicated on June 20, 2025. Around work of that kind, the agency that owns the project, the agency that will eventually operate the service, the City of Pomona as the owner of the surrounding streets, and the construction contractor can each be a distinct defendant with its own notice requirements. Public entities carry the six-month claim deadline; contractors do not, but waiting for clarity is how the six-month deadline gets missed.

General information about California law, not legal advice, and no attorney-client relationship is created by reading it. Deadlines and outcomes turn on the facts of your own matter, so have yours reviewed. By submitting, you agree that Broukhim Legal PC may contact you about your inquiry by phone, text or email.
