Mass tort cases for Downey residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around Downey. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is a Downey injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose, and the Court’s own filing locator returns Norwalk for Downey addresses. Downey Courthouse handles criminal and traffic matters and takes no civil filings, so a Downey injury case is filed in the Southeast District at the Norwalk Courthouse, 12720 Norwalk Boulevard. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. A claim against the City uses the City of Downey Claim Form, published in English and Spanish and delivered or posted to the City Clerk’s Office at 11111 Brookshire Ave, 3rd Floor, on (562) 904-7280. The City states that “claims will not be accepted electronically,” Government Code section 915a requires the claim to be filed with the City Clerk, the published deadlines are six months after the occurrence for personal injury or property damage and one year for real property, and the City asks for copies of supporting documents and photographs and prints a warning that presentation of a false claim is a felony under Penal Code section 72.

Looking for a top-rated, trusted personal injury lawyer in Downey?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of Downey. We know how a Downey claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

COMMON QUESTIONS

Downey questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In Downey the trauma record often sits at St. Francis Medical Center rather than at the hospital you were first taken to, so bring the names of both.

The first conversation costs nothing and creates no obligation. A Downey injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

In the Southeast District, at the Norwalk Courthouse, 12720 Norwalk Boulevard. This surprises people, because Downey has a courthouse of its own, but Downey Courthouse handles criminal and traffic matters and has no civil division at all. Local Rule 2.3(a)(1)(A) requires an unlimited civil injury or wrongful death case to be filed in the judicial district where the incident arose, and the Court’s own filing locator returns Norwalk for Downey addresses. Plan for witnesses and treating doctors to travel, and be sceptical of anything you read online that sends a Downey civil case to the Downey courthouse.

Because neither Downey hospital holds a trauma designation. PIH Health Hospital Downey and Kaiser Foundation Hospital Downey are both absent from the California Emergency Medical Services Authority list of designated trauma centers updated 8/25/2025. The Los Angeles County EMS Agency, which is the designating authority in this county, assigns both of them to St. Francis Medical Center, a Level II adult trauma center, in its umbrella directory effective 1 April 2025, and its catchment map places Downey inside the St. Francis area. For a claim, that commonly means an emergency record at one hospital and the trauma record at another, with separate billing and separate lienholders. Collecting both sets early is how a demand gets built properly.

It depends on the bus. Downey has a city-badged local service, Downey Link, and the city also connects to the Metro C Line, so the answer is not automatic. If it was a Metro vehicle, Metro directs damage claims to Metro Customer Relations at One Gateway Plaza, Los Angeles, and publishes claim forms in English and Spanish, with a stated ninety-day window for its written reply. That ninety days is Metro’s internal timetable and has nothing to do with your own deadline, which is the one that matters. For a city-operated service the claim follows the City of Downey route, on paper, within six months. Identify the operator from the vehicle, the stop or the trip record before any deadline runs.

Yes, in two ways. First, a collision on a freeway is normally investigated by the California Highway Patrol rather than Downey Police, which changes who holds the report. Second, the roadway itself belongs to the state rather than the City, so a claim based on the condition of the road is presented to a different public entity. Downey is also one of five member cities of the I-5 Consortium Cities Joint Powers Authority, with Norwalk, La Mirada, Commerce and Santa Fe Springs, covering Interstate 5 between the I-710 and State Route 91 junctions, and the stretch of I-5 through Downey between the San Gabriel River and Rio Hondo bridges is officially the Downey Police Officer Ricardo Galvez Memorial Highway, designated by the Legislature in 2016.
