Mass tort cases for El Monte residents

Alongside injury work, Broukhim Legal PC takes on mass tort claims for people living in and around El Monte. These cases are consolidated in federal or state court rather than heard locally, so where you live does not limit them.

Where is an El Monte injury case filed, and what are the deadlines?

Under Los Angeles Superior Court Local Rule 2.3(a)(1)(A), an unlimited civil action for bodily injury or wrongful death is filed in the judicial district where the incident arose. The El Monte Courthouse handles criminal and traffic matters only and has no civil division, so an El Monte injury case is filed in the East District at Pomona Courthouse South, 400 Civic Center Plaza. The deadline is generally two years from the date of injury under Code of Civil Procedure section 335.1, and six months to present a written claim where a public entity is involved under Government Code section 911.2, in which case the shorter deadline governs. A claim against the City goes to the City Clerk’s Office at 11333 Valley Boulevard, City Hall E, on (626) 580-2016, on the City of El Monte Claim for Damages form, which must be filed with the City Clerk under Government Code section 915(a), requires a diagram of the place of the accident on the reverse, asks which particular act or omission caused the injury and which City employees and department were involved, and is signed under penalty of perjury. Page two warns in capitals that “all claimants may be required to be examined as to their claim under oath” and that “presentation of a false claim is a felony,” the form’s deadlines are six months for death or injury to person or personal property and one year for other claims, and the posted form still carries a 1990 revision stamp, so expect a paper process rather than a portal.

Looking for a top-rated, trusted personal injury lawyer in El Monte?

Here is what you get when you choose Broukhim Legal PC.

  • Direct access to your lawyer. Bejan Broukhim personally reviews your case and leads its strategy. You can speak directly with him about your case, and if another law firm is ever brought in, that happens only with your written consent.
  • Years of experience, fully licensed. Bejan Broukhim brings years of experience in California personal injury and mass tort law and holds an active California law license, State Bar number 183036.
  • Local knowledge of El Monte. We know how an El Monte claim works: which agency’s report it starts from, which Los Angeles Superior Court district hears it, and the six month deadline that applies when a public agency is involved. That means the early steps that protect your claim start on day one.
  • No fee unless we recover for you. You pay nothing up front. Your case is taken on a contingency fee, so the fee comes out of what is recovered, and if nothing is recovered you owe no fee. The written agreement, signed before any work starts, also explains how case costs are handled.
  • Ready for court. Every case is prepared from day one as though it will go to trial, so any settlement offer is measured against a case that is ready to be tried.

COMMON QUESTIONS

El Monte questions, answered plainly.

The short answer is that it depends on three things: whether someone else’s carelessness caused the injury, what the medical record actually shows, and whether there is insurance that reaches the loss. Those are the questions the first conversation is for. It is free, it takes about half an hour, and if there is nothing worth pursuing you will be told that rather than signed up. Bring whatever you have: the collision or incident report if one exists, photographs, the name of anyone who treated you, and your own insurance policy. In El Monte the police report costs nothing but has to be collected in person at the Police lobby, and the City’s own FAQ says it is generally ready in about ten business days.

The first conversation costs nothing and creates no obligation. An El Monte injury case is taken on a contingency fee, so there is nothing to pay up front and the fee is paid out of what is recovered. If there is no recovery, no fee is owed. The fee agreement is put in writing and signed before any work starts, which is what California law requires, and the costs of running the case are explained in that same agreement rather than left to the end. Ask about it on the first call.

More common, for a city of its size, than anywhere else in the state on the latest figures. In the California Office of Traffic Safety rankings for 2023, where rank 1 is the worst in the group, El Monte ranked 1st of 62 California cities in its population group for hit-and-run collisions causing death or injury, with 80 such collisions. These rankings are rate based, adjusted for population and traffic volume, and the Office itself cautions that they are indicators of potential problems to be read against local circumstances. For a claim, the practical consequence is that your own uninsured motorist coverage often becomes the main route to recovery, and that coverage has its own notice requirements under the policy.

The East District, at Pomona Courthouse South, 400 Civic Center Plaza. The El Monte Courthouse handles criminal and traffic matters and has no civil division, so despite the city having a courthouse, an injury case goes to Pomona. One further caution specific to El Monte: the Court’s filing locator warns that a mailing address may not reflect true geographic location, and for addresses around El Monte, South El Monte, Rosemead and Temple City the locator returns different districts for different ZIP codes. For a collision near a city boundary, the specific street address should be checked rather than the city name.

Not to the hospital in El Monte. Greater El Monte Community Hospital does not appear on the California Emergency Medical Services Authority list of designated trauma centers updated 8/25/2025. The Los Angeles County EMS Agency, which designates trauma centers in this county, lists it in its umbrella directory effective 1 April 2025 under Los Angeles General Medical Center, which the state’s list records as a Level I adult and Level II pediatric trauma center. A seriously injured patient in El Monte can therefore expect to be taken past the nearest hospital, which means the emergency record and the trauma record may sit in different places.

It can, because it is the City’s own record of what it knew about its roads. The El Monte Vision Zero Action Plan, published February 2022, analysed eleven years of state collision data from 2008 to 2019 and counted 1,543 collisions in the city, of which 252 involved pedestrians and 362 involved cyclists, 614 in total or 39.7 percent. It describes the city as “bisected from east to west by Interstate 10 and surrounded by other major interstate and state highways,” with large arterials carrying higher-speed traffic directly into slower local streets. It sets a goal of zero deaths and serious injuries by 2027. Where a collision happened on a corridor the plan addresses, that document is a reasonable starting point for what the City had been told.
